【摘要】： 本文旨在研究法治社會(huì)中的第三部門,通過辨析第三部門的概念特征,尋求第三部門法治思想的起源,捋清第三部門對(duì)于法治社會(huì)的意義,最后探討政府和社會(huì)能夠給予第三部門的法治化支持。 本文除了緒論和結(jié)語之外,主要分為五大部分,主要內(nèi)容概述如下： 第一章具體闡述了第三部門的概念、特征和分類,其中綜合了各國多位學(xué)者的看法觀點(diǎn),旨在對(duì)第三部門做一個(gè)比較科學(xué)的、權(quán)威的、清晰的界定,為下面進(jìn)一步研究奠定基礎(chǔ)。 第二章主要探討了第三部門發(fā)展中的思想理論基礎(chǔ),也就是公民社會(huì)理論。并將西方公民社會(huì)與國家從對(duì)抗到合作的發(fā)展歷程,和第三部門在我國的發(fā)展的歷史相結(jié)合,從中得到一些針對(duì)我國目前國情下第三部門發(fā)展的啟示。 第三章是有關(guān)第三部門和權(quán)力制約模式關(guān)系的,旨在探討第三部門對(duì)制約公共權(quán)力的積極意義。通過比較“權(quán)力制約”和“以社會(huì)制約權(quán)力”這兩種權(quán)力制約模式的利弊,得出符合歷史進(jìn)程和我國現(xiàn)狀的權(quán)力制約模式。 第四章主要講了第三部門對(duì)構(gòu)建我國法治化社會(huì)的意義,充分肯定了第三部門的重要性和不可替代性。同時(shí),也提出了健全的法律制度對(duì)第三部門發(fā)展的重要性。只有建立健全相關(guān)法律法規(guī),第三部門才能健康發(fā)展,發(fā)揮其應(yīng)有的作用。
[Abstract]:The purpose of this paper is to study the third sector of the society ruled by law, through the analysis of the third sector of the concept of the characteristics of the third sector to seek the origin of the third sector of the rule of law, the third sector for the rule of law society significance. Finally, the government and society can give the third sector legal support. In addition to the introduction and conclusion, this paper is divided into five parts, the main content is summarized as follows: The first chapter describes the concept, characteristics and classification of the third sector, which synthesizes the views of many scholars from various countries, aiming at making a more scientific, authoritative and clear definition of the third sector. Lay the foundation for further study below. The second chapter mainly discusses the ideological and theoretical basis of the development of the third sector, that is, the theory of civil society, and the western civil society and the state from confrontation to cooperation in the development process. Combining with the history of the development of the third sector in our country, we can get some enlightenment on the development of the third sector under the current situation of our country. The third chapter is about the relationship between the third sector and the mode of power restriction. The purpose of this paper is to explore the positive significance of the third sector in restricting public power, and to compare the advantages and disadvantages of the two power restriction modes of "power restriction" and "power restriction by society". The model of power restriction in line with the historical process and the present situation of our country is obtained. Chapter 4th mainly discusses the significance of the third sector to the construction of a legalized society in China, and fully affirms the importance and irreplaceable nature of the third sector. It also points out the importance of a sound legal system to the development of the third sector. Only by establishing and perfecting relevant laws and regulations can the third sector develop healthily and play its due role.
