【摘要】：在中國(guó)法治建設(shè)進(jìn)程中,農(nóng)村無(wú)疑是是推進(jìn)國(guó)家法律貫徹執(zhí)行和民主法治建設(shè)的關(guān)鍵領(lǐng)域。作為農(nóng)村治理實(shí)踐的主導(dǎo)者和參與者,基層政府農(nóng)村治理行為的法治化程度,無(wú)疑是事關(guān)農(nóng)村基層治理法治化乃至于國(guó)家治理體系和治理能力現(xiàn)代化的重要因素。本論文以基層政府農(nóng)村治理法治化問題為研究對(duì)象,首先從宏觀及微觀兩個(gè)不同的視域?qū)Ρ疚牡倪x題背景進(jìn)行闡述,在此基礎(chǔ)上分析其理論與實(shí)踐兩個(gè)層次的深刻意義,并根據(jù)國(guó)內(nèi)外學(xué)者已有的學(xué)術(shù)文獻(xiàn)對(duì)研究?jī)?nèi)容的基本范疇予以界定,從而為論文的展開奠定基礎(chǔ)。其次,從縱向的歷史視角,分別對(duì)建國(guó)之前、建國(guó)初期、改革開放后的基層政府農(nóng)村治理行為的模式變遷進(jìn)行梳理,并從新世紀(jì)以后的基層政府農(nóng)村治理行為背景、表現(xiàn)及意義分析其法治化趨向。再次,從理論層面對(duì)基層政府農(nóng)村治理行為法治化的邏輯機(jī)理進(jìn)行具體論證,討論了基層政府農(nóng)村治理行為法治化的社會(huì)基礎(chǔ)、動(dòng)力來源及目標(biāo)設(shè)定,為基層政府更好的對(duì)農(nóng)村進(jìn)行法治化治理提供理論支撐。復(fù)次,筆者從理論回歸現(xiàn)實(shí),通過對(duì)江蘇淮安、南通、鎮(zhèn)江等地農(nóng)村的實(shí)證考察,從基層政府對(duì)于農(nóng)村的普法活動(dòng)、法治文化建設(shè)以及農(nóng)村法律實(shí)施等方面入手分析了我國(guó)部分地區(qū)基層政府農(nóng)村治理行為法治化的現(xiàn)狀,并通過對(duì)此現(xiàn)狀的分析指出基層政府農(nóng)村治理行為法治化中存在的法治目標(biāo)模糊、法治理念、主體結(jié)構(gòu)、法治程序等實(shí)踐困境,進(jìn)而對(duì)其成因進(jìn)行剖析。最后,本文著重探究了基層政府農(nóng)村治理行為法治化可能的進(jìn)路,以期能夠使得基層政府對(duì)農(nóng)村的治理行為在更合理、合法的軌道上運(yùn)行�？傊�,基層政府農(nóng)村治理行為的最終目的是維護(hù)農(nóng)民權(quán)益,促進(jìn)農(nóng)村秩序的穩(wěn)定與社會(huì)發(fā)展,而立足于中國(guó)法治建設(shè)的宏觀背景以及農(nóng)村社會(huì)發(fā)展變化的趨勢(shì),基層政府的農(nóng)村治理行為不僅有著法治化的必要,而且也存在著將基層政府行政行為納入法治軌道,在法治的基礎(chǔ)上凝聚農(nóng)村社會(huì)共識(shí),通過法治維護(hù)和發(fā)展農(nóng)村社會(huì)秩序的現(xiàn)實(shí)可能。
[Abstract]:In the process of China's construction of rule of law, rural areas are undoubtedly the key areas to promote the implementation of national laws and the construction of democratic rule of law, as leaders and participants in the practice of rural governance. The degree of rule by law of rural governance behavior of grass-roots government. Undoubtedly, it is an important factor related to the rule of law in rural grass-roots governance and even the modernization of national governance system and governance ability. This paper focuses on the legalization of rural governance at the grass-roots level as the research object. First of all, from the macro and micro two different perspectives of the background of this topic is expounded, on the basis of this analysis of its theoretical and practical two levels of profound significance. And according to the existing academic literature at home and abroad to define the basic categories of the research content, so as to lay a foundation for the development of the paper. Secondly, from a vertical historical perspective, respectively, before the founding of the people's Republic of China, the founding of the initial period. After the reform and opening up to the grassroots government rural governance behavior model changes to comb, and from the new century grass-roots government rural governance behavior background, performance and significance analysis of its rule of law trend. From the theoretical level, the logic mechanism of rural governance behavior rule by law of grass-roots government is demonstrated, and the social foundation, power source and goal setting of rural governance behavior legalization of grass-roots government are discussed. For the grass-roots government to better rule by law to provide theoretical support. Again, the author from the theory back to reality, through the Jiangsu Huaian, Nantong, Zhenjiang and other rural areas of empirical investigation. This paper analyzes the current situation of rural governance in some areas of our country from the basic level government's activities of popularizing rural law, the construction of culture of rule of law and the implementation of rural law. And through the analysis of the current situation of grass-roots government in rural governance behavior rule by law in the existence of fuzzy legal objectives, the concept of the rule of law, the main structure, legal procedures and other practical difficulties, and then analyze the causes of its formation. Finally. This paper focuses on exploring the possible path to the rule of law of rural governance behavior of grass-roots government, in order to make the rural governance behavior of grass-roots government in a more reasonable and legal track. The ultimate purpose of rural governance behavior of grass-roots government is to safeguard the rights and interests of farmers, promote the stability of rural order and social development, but based on the macro background of China's rule of law construction and the trend of rural social development. The rural governance behavior of grass-roots government not only has the necessity of ruling by law, but also has the necessity to bring the administrative behavior of grass-roots government into the track of rule by law, and to unite the rural social consensus on the basis of the rule of law. It is possible to maintain and develop rural social order through the rule of law.
