【摘要】： 改革開放以來,我國經(jīng)濟(jì)體制正由計(jì)劃經(jīng)濟(jì)體制向市場經(jīng)濟(jì)體制轉(zhuǎn)變并逐步完善,教育領(lǐng)域也逐步建立起與市場經(jīng)濟(jì)體制相適應(yīng)的教育體制。市場經(jīng)濟(jì)是法治經(jīng)濟(jì),大學(xué)是市場經(jīng)濟(jì)主體之一,同樣需要遵循法治的要求。大學(xué)章程建設(shè)是大學(xué)法治進(jìn)程中的重要組成部分,它對構(gòu)建現(xiàn)代大學(xué)制度、推進(jìn)高等教育法治建設(shè)具有重要理論意義,對于進(jìn)一步加強(qiáng)依法治校、深化大學(xué)內(nèi)部管理體制改革等現(xiàn)實(shí)問題有著指導(dǎo)作用。 本文首先分析了法治的定義、特征以及大學(xué)法治的現(xiàn)狀,認(rèn)為我國教育法律法規(guī)呈現(xiàn)雜亂無章狀態(tài),未形成教育立法體系,制約和影響了教育法治和依法治校工作的推進(jìn)。通過界定大學(xué)章程的概念,剖析了大學(xué)章程與教育法律法規(guī)、規(guī)章制度的區(qū)別,揭示大學(xué)章程與法治的內(nèi)在聯(lián)系,提出了大學(xué)章程建設(shè)兩大目標(biāo):合法性和合理性。 其次,梳理了我國大學(xué)章程建設(shè)的歷程分為三個(gè)階段:新中國成立之前的大學(xué)章程;新中國成立至《教育法》頒布期間的章程;《教育法》頒布后的章程。描述了我國公立大學(xué)章程建設(shè)的現(xiàn)狀,在此基礎(chǔ)上,從文本、內(nèi)容、制定、實(shí)施和修改幾方面探究大學(xué)章程建設(shè)中存在的問題。認(rèn)為大學(xué)章程建設(shè)中存在問題的原因在于缺乏大學(xué)章程建設(shè)的經(jīng)驗(yàn),對現(xiàn)代大學(xué)章程認(rèn)識不足,大學(xué)章程的法律地位不明確,章程建設(shè)法律依據(jù)不充分。 最后,本文針對大學(xué)章程建設(shè)中的問題,提出推進(jìn)我國公立大學(xué)章程建設(shè)的對策和建議:優(yōu)化章程建設(shè)的法治環(huán)境,重視重構(gòu)大學(xué)章程建設(shè)主體,提高大學(xué)章程建設(shè)的科學(xué)性。
[Abstract]:Since the reform and opening up, the economic system of our country is changing from the planned economy system to the market economy system and gradually consummating. In the field of education, we have gradually established an educational system that is compatible with the market economy system. Market economy is an economy ruled by law, and universities are one of the main bodies of the market economy. The construction of university charter is an important part of the process of university rule of law, which is of great theoretical significance to the construction of modern university system and the promotion of the construction of the rule of law in higher education. It plays a guiding role in strengthening the administration of schools according to law and deepening the reform of the internal management system of universities. Firstly, this paper analyzes the definition, characteristics and the current situation of the rule of law in universities, and points out that the educational laws and regulations in our country are in a state of chaos and have not formed an educational legislative system. Through defining the concept of university charter, this paper analyzes the difference between university charter and educational laws and regulations, rules and regulations. This paper reveals the internal relationship between the university charter and the rule of law, and puts forward two goals of the university charter construction: legitimacy and rationality. Secondly, the course of university charter construction in China is divided into three stages: the university charter before the founding of New China; Articles of association between the founding of New China and the promulgation of the Education Law; The constitution after the promulgation of the Education Law describes the current situation of the constitution construction of public universities in China, on the basis of which, from the text, content, formulation. This paper probes into the problems existing in the construction of university charter in the implementation and modification of several aspects, and thinks that the reason for the problems in the construction of university charter lies in the lack of experience in the construction of university charter, and the lack of understanding of the modern university charter. The legal status of the university charter is not clear, and the legal basis for the constitution construction is not sufficient. Finally, aiming at the problems in the construction of university charter, this paper puts forward the countermeasures and suggestions to promote the constitution construction of public universities in China: to optimize the rule of law environment of the constitution construction, and to attach importance to the reconstruction of the main body of the university charter construction. To improve the scientific nature of the constitution construction of the university.
