【摘要】:從“非典”以來(lái),問(wèn)責(zé)與監(jiān)督不僅在制度規(guī)定中有了重大進(jìn)展,在實(shí)踐運(yùn)用中也有了一定成效,政府問(wèn)責(zé)制度基本形成。但是,接連發(fā)生的地溝油事件、三鹿奶粉中毒事件、渤海石油污染事件等,說(shuō)明中國(guó)問(wèn)責(zé)制在理論和實(shí)踐中仍然存在很多問(wèn)題。就上述的事件來(lái)看,導(dǎo)致嚴(yán)重后果的原因多大是行政人員的失職行為或?yàn)E用權(quán)力等不當(dāng)行為。從深層次分析,是由于我國(guó)現(xiàn)階段還沒(méi)有形成常態(tài)化、規(guī)范化、法治化的問(wèn)責(zé)機(jī)制。比如:法律體系不健全,制度不完善,行政問(wèn)責(zé)范圍界定不明確,行政問(wèn)責(zé)文化缺失,行政觀念落后,政府回應(yīng)透明化低,再加上問(wèn)責(zé)的隨意性和情緒化所導(dǎo)致問(wèn)責(zé)彈性大的現(xiàn)象等等,不僅使問(wèn)責(zé)的作用十分有限,使問(wèn)責(zé)停留在形式主義階段,甚至影響了問(wèn)責(zé)制度的嚴(yán)肅性和公信力,嚴(yán)重?fù)p害了黨和政府的形象。因此,探討行政問(wèn)責(zé)制實(shí)施中存在的問(wèn)題和進(jìn)一步完善與推行問(wèn)責(zé)制,對(duì)于加快推進(jìn)行政管理體制改革以及實(shí)現(xiàn)建設(shè)責(zé)任政府、法治政府和服務(wù)政府的目標(biāo)具有十分重要的指導(dǎo)意義。 本文依據(jù)社會(huì)契約論、委托-代理理論和責(zé)任政府理論,運(yùn)用理論分析法、文獻(xiàn)研究法、典型個(gè)案法、比較分析法等研究方法,分析了當(dāng)下我國(guó)行政問(wèn)責(zé)制度的實(shí)施現(xiàn)狀,明確了進(jìn)一步完善行政問(wèn)責(zé)制度的緊迫性和必要性。隨后,論文通過(guò)對(duì)幾個(gè)典型事例的剖析,深入分析國(guó)內(nèi)行政問(wèn)責(zé)制中存在的問(wèn)題及產(chǎn)生原因。本文認(rèn)為主要存在的問(wèn)題涉及法律體系、行政問(wèn)責(zé)范圍、行政問(wèn)責(zé)程序、行政問(wèn)責(zé)文化、監(jiān)督舉報(bào)體系等幾個(gè)方面。進(jìn)而,論文研究了西方國(guó)家問(wèn)責(zé)制度的發(fā)展經(jīng)驗(yàn),對(duì)其進(jìn)行了總結(jié)和借鑒。并以此對(duì)我國(guó)行政問(wèn)責(zé)制度的良性發(fā)展提出一系列具有針對(duì)性的對(duì)策,如完善我國(guó)行政問(wèn)責(zé)框架體系、完善立法及其配套制度建設(shè),促進(jìn)行政問(wèn)責(zé)范圍的常態(tài)化,行政問(wèn)責(zé)程序科學(xué)化,筑建我國(guó)行政問(wèn)責(zé)文化和推廣多元化的監(jiān)督舉報(bào)體系等。通過(guò)探討行政問(wèn)責(zé)體系的內(nèi)部構(gòu)成,理論聯(lián)系實(shí)際,以切實(shí)保障政治民主為目的,提出完善行政問(wèn)責(zé)制的建設(shè)性意見(jiàn)。社會(huì)的公平和正義如何在完善行政問(wèn)責(zé)制度過(guò)程中得以體現(xiàn),政府、民眾、媒體等又如何從政策執(zhí)行中履行自身職責(zé),以上提及都將是本文重點(diǎn)研究的問(wèn)題。
[Abstract]:Since SARS, accountability and supervision have not only made great progress in the regulation of the system, but also achieved certain results in practice. The accountability system of the government has basically formed. However, there has been a succession of gutter oil incidents. Sanlu milk powder poisoning incident, Bohai Sea oil pollution incident and so on, shows that there are still many problems in the theory and practice of accountability system in China. The reason for the serious consequences is the misconduct of the administrative personnel such as dereliction of duty or abuse of power. From the deep level analysis, it is because our country has not formed the normalization and standardization at the present stage. Legal accountability mechanism. For example, the legal system is not perfect, the system is not perfect, the scope of administrative accountability is not clear, the culture of administrative accountability is missing, the concept of administration is backward, and the government response is low. In addition, the randomness and emotion of accountability lead to the phenomenon of large accountability elasticity, which not only makes the function of accountability very limited, but also makes accountability stay in the formalism stage. Even affected the seriousness and credibility of the accountability system, seriously damaged the image of the party and the government. Therefore, to explore the implementation of administrative accountability system problems and further improve and implement the accountability system. It is of great significance to accelerate the reform of administrative system and to realize the goal of building responsible government, government by law and service government. Based on the theory of social contract, principal-agent theory and the theory of responsible government, this paper uses theoretical analysis, literature research, typical case law, comparative analysis and other research methods. This paper analyzes the current status of the implementation of the administrative accountability system in China, and clarifies the urgency and necessity of further improving the administrative accountability system. Subsequently, the paper analyzes several typical cases. This paper analyzes the existing problems and causes of the domestic administrative accountability system. The main problems related to the legal system, the scope of administrative accountability, administrative accountability procedures, administrative accountability culture. Then, the paper studies the development experience of accountability system in western countries. To sum up and draw lessons from, and put forward a series of targeted countermeasures to the benign development of our administrative accountability system, such as perfecting our administrative accountability framework system, improving legislation and its supporting system construction. To promote the normalization of the scope of administrative accountability, the process of administrative accountability to scientific, to build a culture of administrative accountability in China and to promote a diversified system of supervision and reporting. Through the discussion of the internal composition of the administrative accountability system. Combining theory with practice, aiming at ensuring political democracy, this paper puts forward constructive suggestions on how to perfect the administrative accountability system. How social fairness and justice can be reflected in the process of perfecting the administrative accountability system, the government and the public. Media and so on how to carry out their own duties from the implementation of policies, mentioned above will be the focus of this study.
