【摘要】：《中華人民共和國憲法》規(guī)定:中華人民共和國的一切權(quán)力屬于人民,人民代表大會是人民行使國家權(quán)力的機關(guān),人民代表大會制度是保證人民當家作主的根本政治制度,1鄉(xiāng)鎮(zhèn)人民代表大會作為我國最基層的權(quán)力機關(guān),在傳達政情民意、監(jiān)督基層政權(quán)方面有著重要作用,也是與人民群眾距離最近、接觸最多的政權(quán)組織。但是由于諸多原因,鄉(xiāng)鎮(zhèn)人民代表大會的實際作用與憲法和其他法律所賦予的職權(quán)仍有較大差距,在現(xiàn)實運作中面臨著地位之虛、結(jié)構(gòu)之困、履職之限、監(jiān)督之難等困境。2特別是近年來,隨著全國人民代表大會制度建設(shè)相關(guān)法律法規(guī)的不斷完善,陜西鄉(xiāng)鎮(zhèn)人大制度建設(shè)在實踐的發(fā)展中還存在諸多問題,與《憲法》賦予的相關(guān)職能、三秦父老的期望仍有不小的差距。正是在這樣的背景下,本文將陜西鄉(xiāng)鎮(zhèn)人大制度建設(shè)置于鄉(xiāng)村治理這一概念中進行研究,綜合應(yīng)用文獻研究法、調(diào)查法、定性分析等研究方法,在結(jié)合調(diào)查問卷和實地調(diào)研的基礎(chǔ)上,試圖通過對陜西鄉(xiāng)鎮(zhèn)人民代表大會制度的深入分析得出結(jié)論,給出相應(yīng)建議,從而改善陜西鄉(xiāng)鎮(zhèn)人大的現(xiàn)狀,使其實現(xiàn)憲法和法律賦予的職能,早日實現(xiàn)陜西地方治理現(xiàn)代化及國家治理體系和治理能力現(xiàn)代化的目標。全文分為六部分內(nèi)容,首先,通過對國內(nèi)外研究的相關(guān)綜述得出鄉(xiāng)鎮(zhèn)人大制度建設(shè)研究的現(xiàn)狀;其次,通過對“鄉(xiāng)村治理”、“鄉(xiāng)鎮(zhèn)人大制度”、“基層民主自治與法治”等基本概念的概述和厘定,對相關(guān)概念進行鑒定;再次,通過對陜西鄉(xiāng)村治理和陜西鄉(xiāng)鎮(zhèn)人大制度建設(shè)的現(xiàn)狀、存在問題及原因的探究分析,得出陜西鄉(xiāng)鎮(zhèn)人大制度建設(shè)面臨的困境;最后,在綜上所述的基礎(chǔ)上總結(jié)出陜西鄉(xiāng)村治理中鄉(xiāng)鎮(zhèn)人大制度建設(shè)的路徑選擇。
[Abstract]:The Constitution of the people's Republic of China stipulates that all powers of the people's Republic of China belong to the people, and the people's Congress is the organ by which the people exercise state power. The people's Congress system is the fundamental political system which ensures the people to be the master of the country. As the most basic power organ of our country, the township people's Congress plays an important role in conveying the political situation and public opinion and supervising the grassroots political power. But for many reasons, the actual role of the township people's congresses is still far from the functions and powers conferred by the Constitution and other laws, but there is still a big gap between the actual role of the township people's congresses and the functions and powers conferred by the Constitution and other laws. In the practical operation is facing the status of virtual, structural difficulties, limits to perform their duties, supervision difficulties and other dilemmas .2 especially in recent years, with the National people's Congress system construction related laws and regulations continue to improve. There are still many problems in the practice of the construction of Shaanxi township people's Congress system. There is still a big gap between the related functions given by the Constitution and the expectations of the old and father of Sanqin. It is precisely against this background that there are still many problems in the construction of the township people's Congress system in Shaanxi Province. This paper puts the system construction of Shaanxi Township people's Congress into the concept of rural governance, and applies the methods of literature research, investigation, qualitative analysis and so on, on the basis of questionnaire and field investigation. This paper attempts to draw a conclusion through the in-depth analysis of the system of Shaanxi township people's congresses and give corresponding suggestions so as to improve the present situation of Shaanxi township people's congresses and enable them to realize the functions conferred by the constitution and law. The goal of realizing the modernization of Shaanxi local governance and the modernization of national governance system and governance capacity as soon as possible. The full text is divided into six parts, first of all. Through the domestic and foreign research related summary obtains the township people's Congress system construction research present situation; Secondly, through the summary and determination of the basic concepts of "rural governance", "township people's Congress system", "grass-roots democratic autonomy and rule of law" and other basic concepts, the relevant concepts are identified. Thirdly, through the analysis of the present situation, problems and reasons of the rural governance and the system construction of Shaanxi township people's Congress, the difficulties facing the construction of Shaanxi township people's Congress system are obtained. Finally, on the basis of summing up the above, summed up the rural governance in Shaanxi township people's Congress system construction path choice.
