【摘要】：城市管理與行政執(zhí)法部門是城市管理的主導(dǎo)力量，在規(guī)范城市管理、改善市容市貌、提高城市文明程度、塑造城市形象、促進城市發(fā)展方面起著重要作用。隨著城管執(zhí)法工作在城市管理中的作用越來越突出，城管執(zhí)法面臨的形勢也越來越嚴重，與執(zhí)法對象之間的矛盾也層出不窮，，無法避免，這些都成為困擾城管執(zhí)法的難點。再加上社會主義民主法制建設(shè)程度越來越高，人民群眾的思想覺悟也逐漸提高，對城管執(zhí)法工作的要求逐漸增多，迫切要求城管在執(zhí)法過程中堅持以人為本，實行人性化執(zhí)法。人性化執(zhí)法是法治社會的要求，也是和諧社會對城管執(zhí)法工作的要求，在執(zhí)法工作中，城市管理人員要給予執(zhí)法對象充分的人文主義關(guān)懷，從執(zhí)法對象的實際出發(fā)，在維護他們的利益的基礎(chǔ)上，加強社會管理，創(chuàng)新管理體制，提升管理效果，不僅要做到執(zhí)法的科學性和公正性，也要實現(xiàn)執(zhí)法的民主性和有效性。 本文按照“發(fā)現(xiàn)問題—分析問題—解決問題”的研究思路，旨在探索推進城管人性化執(zhí)法的對策。本文分析了城管人性化執(zhí)法的含義和重要性，以瑞安市為例，分析了當前城管人性化執(zhí)法的成績、存在的問題和存在問題的根源，并提出了推進城管人性化執(zhí)法的對策建議，為城市管理行政執(zhí)法部門的相關(guān)工作提供理論借鑒。 本文在以下兩個方面有所創(chuàng)新：一是豐富了學科視角。本文將城市管理與法律規(guī)范相結(jié)合，改變了從行政學的單一學科視角研究城市管理的傳統(tǒng)思維模式，也可以避免單一視角帶來的弊端，從行政學、管理學、法學多學科角度研究城管執(zhí)法，將學科理論綜合融入到城管執(zhí)法中，從而提出了更符合實際的完善對策。二是一改以往單純的理論闡釋，以瑞安市城市管理部門為例，運用鮮活的案例，對城管執(zhí)法進行研究，將理論與實踐結(jié)合起來，避免二者脫節(jié)。
[Abstract]:City management and administrative law enforcement departments is the leading force in the city management, standardized city management, improve the appearance of the city, improve the city civilization degree, shaping the image of the city, plays an important role in promoting city development. With the increasingly prominent role of urban management and law enforcement in urban management, the situation of urban management and law enforcement is becoming more and more serious, and the contradiction between law enforcement objects is endless. Coupled with the increasing degree of socialist democracy and legal system construction, people's ideological awareness is gradually improving, and the demand for urban management and law enforcement is increasing. It is urgent for urban management to adhere to the people-oriented principle and enforce the humanized law enforcement in the process of law enforcement. Humane law enforcement is the rule of law society, a harmonious society as well as requirements for urban management and law enforcement, in law enforcement, city managers should give humanistic care fully the object of law enforcement, starting from the actual object of law enforcement, based on their interests, strengthen social management and innovation management system, improve management efficiency and not only do the scientific and impartial law enforcement, also to achieve democracy and effectiveness of law enforcement.
