在馬克思主義理論剛剛傳入中國的時候,中國的有識之士以極大的熱情研讀馬克思主義的著作,并將其奉為經(jīng)典,這其中也包括后來中國共產(chǎn)黨的早期成員。從中國共產(chǎn)黨成立的那一刻起,便將馬克思主義作為自己的指導思想,并將其運用到中國的革命實踐中,但是年輕的共產(chǎn)黨人卻沒有認識到,馬克思主義理論雖然偉大,但卻不具有普適性,不可生搬硬套地適用于各種情況,于是,在經(jīng)歷了照搬馬克思主義理論的教訓后,中國共產(chǎn)黨人開始了將馬克思主義中國化的歷程,并最終取得了諸多成就。馬克思主義法學作為馬克思主義理論的重要組成部分,也不可避開地經(jīng)歷了一個被推崇然后被教條化地運用,再到實現(xiàn)中國化的過程。在這一過程中,無數(shù)的共產(chǎn)黨人為此做出了貢獻,而在這些人當中,有一個人有著極其重要的地位,那就是董必武。作為中國共產(chǎn)黨早期的領導人中少數(shù)系統(tǒng)學習過法學的人之一,董必武在進行革命和國家建設的同時,深入學習研究馬克思主義的法學思想,深刻剖析中國的社會現(xiàn)實,將馬克思主義法學思想與中國的現(xiàn)實國情相結合,提出了一套具有獨創(chuàng)性和中國特色的完整的法學思想,推動了新中國法制建設的進程,極大地豐富了毛澤東思想,為鄧小平理論提供了思想資料,在馬克思主義法學中國化的過程中發(fā)揮了重要作用。本文第一章對馬克思主義的經(jīng)典法學思想作了簡單梳理;第二章首先淺析淺析了馬克思主義法學思想不能直接適用于中國實際的理由,還有中國照搬馬克思主義法學的表現(xiàn)和經(jīng)驗教訓,然后總結董必武對中國國情的淺析淺析和其法學思想,使讀者從中看出董必武將馬克思主義法學中國化的理由及過程;第三章,總結董必武在馬克思主義法學中國化過程中的地位和影響。通過本文的淺析淺析和論述使人們更清楚地認識到馬克思主義法學中國化的重大意 義和董必武在此過程中所作的貢獻,也希望能為中國正在進行的法治國家的建設提供一定的幫助。

【Abstract】 At the beginning of Marxism has introduced to China,Chinese people of vision read and research the works of Marxism with great passion,and look it as classics,among these people there some early members of the Communist Party of China.From the first day of the Communist Party of China,they already regarded the Marxism as their guiding ideology,and be used to Chinese revolution,but young Communists didn’t realize though the Marxism is very great,but it isn’t have universality,do not use it in all sort of condition.So,when the Communists took in the lesson,they start the course of let the Marxism become chinization,and finally have more achievement.As the important part of the Marxism,Marxist jurisprudence experienced a such process:from be praised highly to be used dogmatic to achieved chinization.During this process,that one person’s devotion is must mention,that is Dong Biwu.As one of the learly leaders of the Communist Party of China who knows jurisprudence,when he is doing his career of revolution and contribute the country,he also research the Marxist jurisprudence,analyse Chinese social reality,then he make the Marxist jurisprudence and the social reality of China fall together,propose a whole legal theory by himself,that is so splendent in Chinese legal history,it also a very important part of the process of making Marxist jurisprudence become chinization.This thesis carding the classic legal thoughts of Marxism,and then set forth Dong Biwu’s analyse of Chinese social reality,and then get the reason of why he make the Marxist jurisprudence become chinization and the process of his work,next,the writer analyses Dong Biwu’s place and effect during the process of make the Marxist jurisprudence become chinization.Get through those analyse and exposition make people to realize the important meaning of making Marxist jurisprudence become chinization,and we hope that we can do something for our career of contribute a country under the rule of law.
