【摘要】：市民社會和政治國家的分離是黑格爾的法哲學所要解決的主要問題。通過市民社會和政治國家之外在必然性和內(nèi)在目的性的結(jié)合,黑格爾把問題的解決訴諸理性神學的國家。通過指證黑格爾關(guān)于市民社會和政治國家之間外在必然性和內(nèi)在目的性的二律背反以及對其結(jié)合方式的神秘同一性的批判,馬克思指明了在黑格爾法哲學中所存在的市民社會和政治國家分離的兩個維度,即特殊利益和普遍利益的分離以及世俗社會與政治社會的分離。通過對這兩個維度的批判,馬克思重構(gòu)了市民社會和政治國家的關(guān)系,指明了市民社會的基礎地位,同時把所有分離和矛盾的根源導回到市民社會自身,轉(zhuǎn)化為在社會批判的層面上解決這個問題,從而實現(xiàn)了從政治批判向社會批判的轉(zhuǎn)向。
[Abstract]:The separation of civil society and political state is the main problem of Hegel's philosophy of law. Through the combination of necessity and internal purpose outside civil society and political state, Hegel resorts to rational theology to solve problems. By pointing out Hegel's criticism of the external necessity and internal purpose between civil society and political state and the mysterious identity of its combination, Marx pointed out the two dimensions of the separation of civil society and political state in Hegel's philosophy of law, namely, the separation of special interests and universal interests, and the separation of secular society and political society. By criticizing these two dimensions, Marx reconstructs the relationship between civil society and political state, points out the basic status of civil society, and at the same time leads all the sources of separation and contradiction back to the civil society itself. It is transformed into solving this problem on the level of social criticism, thus realizing the turn from political criticism to social criticism.
