【摘要】：正義的現(xiàn)實(shí)性與超越性是馬克思正義觀念的兩個(gè)不同位階,后者是一個(gè)既批判又涵蓋前者的概念,二者既是邏輯相連的又是歷史連續(xù)的,共同構(gòu)成了馬克思正義理論的辯證結(jié)構(gòu)�，F(xiàn)實(shí)性正義與超越性正義分別是資本主義社會(huì)和共產(chǎn)主義社會(huì)占主流地位的正義形態(tài),只有當(dāng)歷史發(fā)展從資本主義社會(huì)過渡到共產(chǎn)主義社會(huì)時(shí),才可能從現(xiàn)實(shí)性正義過渡到超越性正義�，F(xiàn)實(shí)性正義內(nèi)蘊(yùn)著兩個(gè)性質(zhì)截然相反的形態(tài):交換領(lǐng)域的形式性正義和生產(chǎn)領(lǐng)域的實(shí)質(zhì)性非正義;超越性正義內(nèi)蘊(yùn)著兩個(gè)歷史相續(xù)的正義原則,即貢獻(xiàn)原則和需要原則。馬克思正義理論的確立離不開作為世界觀的歷史唯物主義,歷史唯物主義的創(chuàng)立為思考正義問題提供了新的方法論原則,即歷史原則。
[Abstract]:The reality and transcendence of justice are two different levels of Marx's concept of justice. The latter is a concept that both criticizes and covers the former. Together constitute the dialectical structure of Marx's theory of justice. Realistic justice and transcendental justice are the main forms of justice in capitalist society and communist society respectively. Only when the historical development from capitalist society to communist society, It is possible to transition from realistic justice to transcendental justice. Realistic justice contains two opposite forms: formal justice in the field of exchange and substantive injustice in the field of production, and transcendental justice contains two historical principles of justice, namely, the principle of contribution and the principle of need. The establishment of Marx's theory of justice can not be separated from historical materialism as a world outlook. The establishment of historical materialism provides a new methodological principle for thinking about the problem of justice, that is, historical principle.
