馬克思主義法社會學視角下社會組織解紛機制實證分析

【摘要】:當代中國的核心問題并非社會問題本身,而是解決問題的方法、路徑的選擇,因為它決定了今后中國社會是問題更多、更突出、更尖銳,還是社會問題的解決步入一個成熟的自我調(diào)適的軌道。本論文的全部著力點在于為理性、非暴力化的糾紛解決提供一個與中國法律文化傳統(tǒng)和現(xiàn)實社會結構相適應的社會運行機制。同時希望通過分析糾紛解決這一社會剖面,指出建設一個與公民社會相適應的社會組織系統(tǒng),是中國漸進政治變革的前提和條件。 馬克思主義法社會學的基本原理為我們提供了一個國家一社會—法律的理論框架。從社會中思考糾紛的解決,從糾紛解決中反觀社會結構的缺失;在國家與社會互動中解決糾紛,在正式規(guī)則與非正式規(guī)則互為補充中解決糾紛。在這一宏觀背景下,社會組織成為社會解紛機制的中心環(huán)節(jié)。在建設和改革社會組織的同時,必須清楚社會組織解紛的權力來源問題,回避和漠視這一問題,就無法使社會解紛形成有效的運行機制。如何有效發(fā)揮社會組織的解紛功能,不能再從制度到制度或從法律到法律中思考。必須跳出制度和法律之外,必須在馬克思主義法哲學關于理想社會的指引下,以人的自由為核心價值觀作為糾紛解決的基本思想。必須充分借鑒西方馬克思主義的研究成果,運用程序主義的法律范式,以主體間性為進路,發(fā)現(xiàn)以交往權力、教化權力為核心的社會解紛機制的理論依據(jù),克服現(xiàn)實形式主義法治和實質(zhì)主義法治模式的失靈。理論的假設必須符合實際的需求和社會現(xiàn)實,因此,必須運用社會學實證研究方法,從歷史角度實證考察中國社會法律文化傳統(tǒng),從現(xiàn)實糾紛解決的角度發(fā)現(xiàn)現(xiàn)有糾紛解決體制的局限和不足,從社會試驗的角度發(fā)現(xiàn)理論假設在應用中的問題。論文對這一問題的答案是:在程序性法律范式的指導下,以參與者的視角運用交往理論,自由建構扎根于公民社會的社會組織,通過組織和規(guī)范兩大原則實現(xiàn)社會力量的建制化,從而獲取社會權力,使社會組織解紛獲取合法性,使其對現(xiàn)實糾紛的解決產(chǎn)生充分的效力,進而形成社會組織解紛的新機制。從社會組織的角色定位分析,這種新機制分為三個方面,即“代理人”角色的社會組織解紛機制、“中介人”角色的社會組織解紛機制、“互動人”角色的社會組織解紛機制!按砣恕苯巧纳鐣M織解紛的權力來源于交往權力,需要建立社會組織的內(nèi)部治理結構和理順社會組織的外部關系組織模式,通過制訂行業(yè)內(nèi)爭議處理辦法,協(xié)調(diào)解決各種矛盾,維護社會穩(wěn)定。如制訂行業(yè)內(nèi)爭議處理的規(guī)則、程序,代表本行業(yè)參與行業(yè)性談判,受理會員的投訴,為會員提供幫助,維護公平競爭的市場規(guī)則、程序,代表本行業(yè)參與行業(yè)性談判,受理會員的投訴,為會員提供幫助,維護公平競爭的市場經(jīng)濟秩序;受理社會對會員的投訴,查處會員的違規(guī)違法行為;幫助會員辦好僅靠自身力量難以辦成的事情,反映會員的意見和呼聲!爸薪槿恕苯巧纳鐣M織解紛機制來源于教化權力,包括仲裁委員會、調(diào)解委員會、爭議解決中心等組織在內(nèi)的共益型社會組織應當在資金來源、司法確認以及適格的調(diào)解員等方面建立組織模式。以適格的調(diào)解人、理性商談、與司法機關的互動等為基礎建立解紛方式!盎尤恕苯巧纳鐣M織解紛機制的權力來源于公權力,應當建立以核心價值觀、捐贈人大會以及信息披露等制度為基礎的組織模式,建立以社會組織的公益訴訟為基礎的解紛方式。 微觀上充分發(fā)揮社會組織解紛作用,有利于化解社會沖突和矛盾,有利于提高社會組織的公信力,有利于整合社會力量,有利于推動中國特色的社會建設的發(fā)展。公民社會組織解紛機制的發(fā)揮是現(xiàn)實政治體制改革、社會體制改革以及新型社會建設的切入口。
[Abstract]:The core problem of contemporary China is not the social problem itself, but the way to solve the problem, the choice of the path, because it determines that the Chinese society is more problems, more prominent, more sharp, or the solution of the social problems into a mature track of self adjustment in the future. The whole focus of this thesis is to be rational and non violent. At the same time, we hope to solve this social section by analyzing disputes and point out that building a social organization system adapted to civil society is the prerequisite and condition for the gradual political change in China.
The basic principle of Sociology of Sociology of Marx doctrine provides us a theoretical framework of society and law in a state. From the society, we think about the settlement of disputes, the lack of social structure in the dispute settlement, the settlement of disputes in the interaction between the state and the society, and the settlement of disputes between the formal rules and the non formal rules. Under the macro background, the social organization is the central link of the social dispute settlement mechanism. While building and reforming the social organization, it is necessary to clear the source of power of the social organization to solve the dispute, avoid and ignore this problem, and can not make the social dispute dispute form an effective operation mechanism. It must be taken out of the system and law from law to law. It must be taken out of the system and law. Under the guidance of the ideal society, the core values of human freedom must be taken as the basic thought of the resolution of the core values of Marx's philosophy of law. We must fully learn from the research results of Western Marx doctrine and apply the procedural law paradigm. On the basis of intersubjectivity, we find the theoretical basis for the mechanism of social dispute settlement with the core of communication power and teaching power, and overcome the failure of the rule of law and the rule of law. The theoretical hypothesis must conform to the actual needs and social realities. Therefore, it is necessary to use the empirical research method of sociology to demonstrate from the historical point of view. In view of the Chinese social legal culture tradition, the limitations and shortcomings of the existing dispute settlement system are found from the angle of practical dispute resolution, and the problems in the application of the theoretical hypothesis are found from the angle of the social experiment. The answer to this question is: under the guidance of the procedural legal paradigm, the theory of communication is applied in the perspective of participants. To construct the social organization rooted in the civil society, to achieve the social power by organizing and standardizing the two principles of social power, so as to obtain social power, make the social organization get the legitimacy of the dispute, make it fully effective for the settlement of the real disputes, and then form a new mechanism for the social organization to solve the dispute. The new mechanism is divided into three aspects, namely, the social organization resolving mechanism of the "agent" role, the social organization of "intermediary" role, the social organization of the role of "interactive man", the power of the social organization of the "agent" role derives from the communication power and needs to establish the internal governance of the social organization. Giving full play to the role of social organization to resolve disputes is beneficial to dissolve social conflicts and contradictions, to improve the credibility of social organizations, to integrate social forces and to promote the development of social construction with Chinese characteristics.
