【摘要】：黨的十八屆四中全會關(guān)于依憲執(zhí)政理念的提出,經(jīng)過了長期的探索過程,是執(zhí)政黨治國理論的重大發(fā)展,凝聚著中國共產(chǎn)黨人為建設(shè)社會主義法治國家所作的努力和經(jīng)驗(yàn)。憲法是一國的根本大法,是治國安邦的總章程。依憲執(zhí)政是新中國民主、法治發(fā)展的歷史經(jīng)驗(yàn)總結(jié),也是改革、開放的現(xiàn)實(shí)必然要求。依憲執(zhí)政最基本的內(nèi)涵就是完整、嚴(yán)格地實(shí)施現(xiàn)行憲法,其基本的要求是賴以實(shí)施的憲法是一部良好的憲法。依憲執(zhí)政要求黨要按照憲法的邏輯思考和解決各種社會問題,其基本要求是要樹立憲法法律權(quán)威、規(guī)范黨的執(zhí)政權(quán)力和保護(hù)公民權(quán)利。提高黨的憲法理念和尊重保障人權(quán)是黨的依憲執(zhí)政的重要內(nèi)容。依照憲法執(zhí)政能制約權(quán)力的專橫,防止權(quán)力腐敗,凝聚全民共識,堅定人民對法治發(fā)展的信心。依憲執(zhí)政有利于實(shí)現(xiàn)黨的領(lǐng)導(dǎo)、人民當(dāng)家作主和依法治國的有機(jī)統(tǒng)一。要實(shí)現(xiàn)依憲執(zhí)政,當(dāng)下最急需的是健全國家法律的完善黨內(nèi)法規(guī)體系,科學(xué)界定執(zhí)政權(quán),正確發(fā)揮國家機(jī)關(guān)中黨組的作用,避免黨過分干涉國家機(jī)關(guān)合法行使職權(quán)。黨委要理順決策的體制和機(jī)制,加強(qiáng)黨的依法決策和民主決策。黨委還要建立健全責(zé)任追究制度,對領(lǐng)導(dǎo)干部的決策失誤進(jìn)行終身的問責(zé),時刻提醒領(lǐng)導(dǎo)干部謹(jǐn)慎科學(xué)決策。改革和完善紀(jì)委監(jiān)督是當(dāng)前依憲執(zhí)政的重點(diǎn)和難點(diǎn),黨的監(jiān)督機(jī)制是否完善關(guān)系著黨能否有效防治腐敗問題,加強(qiáng)同級紀(jì)委對同級黨委腐敗案件的監(jiān)督是當(dāng)前解決黨內(nèi)腐敗案件的重中之重。同時,我們應(yīng)加強(qiáng)黨員主體監(jiān)督,擴(kuò)大監(jiān)督的基礎(chǔ)。
[Abstract]:The proposal of the fourth Plenary session of the 18th CPC Central Committee on ruling by the Constitution has gone through a long exploration process, which is an important development of the governing theory of the ruling party, and condenses the efforts and experiences made by the Chinese Communists to build a socialist country ruled by law.Constitution is the fundamental law of a country and the general constitution of ruling a country.Ruling by the Constitution is the historical experience of democracy and rule by law in New China, and is also the inevitable requirement of reform and openness.The most basic connotation of governing according to the constitution is to complete and strictly implement the current constitution. Its basic requirement is that the constitution on which it is implemented is a good constitution.Governing according to the Constitution requires the Party to think and solve various social problems according to the logic of the Constitution. The basic requirement is to establish the authority of the Constitution, to regulate the ruling power of the Party and to protect the civil rights.Improving the party's constitutional concept and respecting and protecting human rights are the important contents of the party's constitutionality.Ruling in accordance with the Constitution can restrict the tyranny of power, prevent power corruption, condense the consensus of the whole people, and strengthen the people's confidence in the development of the rule of law.Ruling by the Constitution is conducive to the organic unity of the Party's leadership, the people as masters and the rule of law.In order to be in power in accordance with the Constitution, what is most urgently needed is to perfect the system of laws and regulations of the state, to scientifically define the ruling power, to give full play to the role of party groups in state organs, and to avoid excessive interference by the Party in the lawful exercise of functions and powers of state organs.The party committee should straighten out the system and mechanism of decision-making and strengthen the party's decision-making according to law and democracy.Party committees also need to establish and improve the system of accountability for responsibility, to hold leading cadres accountable for their decision-making mistakes for life, and to remind leading cadres to make prudent and scientific decisions at all times.To reform and improve the supervision of the discipline Inspection Commission is the key and difficult point of ruling in accordance with the Constitution. Whether the Party's supervision mechanism is perfect or not is related to whether the party can effectively prevent and cure corruption.Strengthening the supervision of the corruption cases of the Party committees at the same level is the most important task to solve the corruption cases in the Party.At the same time, we should strengthen the main supervision of party members and expand the basis of supervision.
