【摘要】：基因技術(shù)的發(fā)展為人類(lèi)福祉的提升提供了廣闊的空間,也為人類(lèi)社會(huì)的有序發(fā)展帶來(lái)了前所未有的問(wèn)題。在這種背景下產(chǎn)生的“基因歧視”現(xiàn)象,使我們面臨著新的嚴(yán)峻的挑戰(zhàn),它使我們對(duì)社會(huì)平等、公正進(jìn)行再次審視,并力圖找尋解決的途徑。 論文主要從平等的進(jìn)路來(lái)研究中國(guó)基因歧視問(wèn)題。首先對(duì)馬克思主義平等理論進(jìn)行了回顧和總結(jié),認(rèn)為平等既是馬克思主義先行者們用以批判資本主義的武器,也是他們孜孜以求追尋的目標(biāo)。在馬克思主義看來(lái),自然的、天賦的不平等不應(yīng)該構(gòu)成不平等的理由；人的基本權(quán)利的保障、平等的達(dá)到,必須反對(duì)不平等的現(xiàn)象、反對(duì)歧視；真正平等的實(shí)現(xiàn),既是人的自由而全面發(fā)展,也是理想社會(huì)實(shí)現(xiàn)的必要條件。 其次,論文梳理了西方主流平等觀及其對(duì)西方反基因歧視法規(guī)的影響和指導(dǎo)意義。認(rèn)為西方自由主義的平等觀以“認(rèn)真對(duì)待公民的權(quán)利”的原則、注重“平等關(guān)懷和尊重”原則、“關(guān)注弱勢(shì)群體”體現(xiàn)在反基因歧視法規(guī)。這些理念和原則,為中國(guó)反基因歧視提供了有價(jià)值的借鑒和參考意義。 最后,論文試圖在總結(jié)西方反基因歧視經(jīng)驗(yàn)的基礎(chǔ)上,來(lái)分析中國(guó)基因歧視的現(xiàn)狀和反基因歧視存在的困難,在馬克思主義平等理論的框架下提出適合中國(guó)現(xiàn)狀的反基因歧視建議。
[Abstract]:The development of genetic technology provides a broad space for the promotion of human well-being and brings unprecedented problems to the orderly development of human society. It makes us examine social equality and justice again and try to find a way to solve it. This paper mainly studies the problem of genetic discrimination in China from the perspective of equality. Firstly, it reviews and summarizes the theory of Marxist equality, and holds that equality is the weapon used by the pioneers of Marxism to criticize capitalism. In the view of Marxism, natural and natural inequality should not constitute the reason for inequality, the guarantee of human's basic rights and the achievement of equality must oppose the phenomenon of inequality and against discrimination. The realization of real equality is not only the free and comprehensive development of human beings, but also the necessary condition for the realization of ideal society. Secondly, the paper combs the western mainstream view of equality and its influence and guiding significance on the western anti-genetic discrimination law. It holds that the western liberal view of equality is based on the principle of "taking citizens' rights seriously". Paying attention to the principle of "equal care and respect" and "paying attention to the vulnerable groups" are embodied in the laws and regulations of anti-genetic discrimination. These ideas and principles provide valuable reference and reference for China's anti-genetic discrimination. Finally, the paper attempts to analyze the current situation of genetic discrimination and the difficulties of anti-genetic discrimination in China on the basis of summing up the experience of anti-gene discrimination in the West. Under the framework of Marxist equality theory, this paper puts forward anti-genetic discrimination suggestion suitable for China's current situation.
