【摘要】：圖爾敏的論證邏輯理論是在維特根斯坦、奧斯汀、塞爾以及賴爾思想的影響下，通過對形式邏輯局限性的思考以及對法律論證模式的借鑒而發(fā)展起來的理論體系。圖爾敏的論證模式包括基本模式與擴(kuò)展模式�；灸Ｊ降臉�(gòu)成要素為主張、根據(jù)和正當(dāng)理由，，擴(kuò)展模式在基本模式的基礎(chǔ)之上引入了支援、反駁和限定詞等概念。該模式以法律論證的結(jié)構(gòu)為模型，突破了傳統(tǒng)形式邏輯論證模式的結(jié)構(gòu)限制，將“或然性”以及擴(kuò)展的有效性的概念引入了論證的形式結(jié)構(gòu)中，實(shí)現(xiàn)了相對主義與絕對主義、歷史主義同經(jīng)驗(yàn)主義的辯證統(tǒng)一。圖爾敏認(rèn)為，不同的論證領(lǐng)域間存在著“領(lǐng)域不變的”和“領(lǐng)域依賴的”的性質(zhì)差別，因此論證的比較與評價(jià)只能在相關(guān)的領(lǐng)域內(nèi)進(jìn)行，而不可在不同的領(lǐng)域間展開。論證領(lǐng)域理論作為圖爾敏論證邏輯理論的核心內(nèi)容之一，為論證邏輯理論的跨領(lǐng)域的廣泛應(yīng)用以及對各領(lǐng)域論證標(biāo)準(zhǔn)的評價(jià)奠定了堅(jiān)實(shí)的基礎(chǔ)，使得其在法律、數(shù)學(xué)以及修辭等諸多領(lǐng)域都得到了具體的應(yīng)用。 雖然圖爾敏的論證邏輯理論存在著一定的局限性，但這一理論的提出不僅開啟了當(dāng)代邏輯學(xué)的實(shí)踐轉(zhuǎn)向，而且使邏輯學(xué)界得以重新審視邏輯的觀念。因此可以說，圖爾敏的論證邏輯理論對邏輯學(xué)的研究與發(fā)展產(chǎn)生了深遠(yuǎn)的影響。
[Abstract]:Tourmin's argumentation logic theory is a theoretical system developed under the influence of Wittgenstein, Austin, Searle and Raier's thoughts, through thinking about the limitation of formal logic and drawing lessons from the mode of legal argumentation. Tourmin's argumentation model includes basic model and extended mode. The constituent elements of the basic pattern are the claim. According to and justified reasons, the extended pattern introduces the concepts of support, refutation and qualifier on the basis of the basic pattern. The model takes the structure of legal argumentation as the model, breaks through the structural limitation of the traditional formal logic argumentation model, introduces the concepts of "probability" and extended validity into the formal structure of the argumentation, and realizes relativism and absolutism. The dialectical unity of historicism and empiricism. Tourmin believes that there are differences in the nature of "domain invariant" and "domain-dependent" among different argumentation fields, so the comparison and evaluation of argumentation can only be carried out in the relevant fields, but not in different fields. As one of the core contents of Tulmin's argumentation logic theory, argumentation domain theory has laid a solid foundation for the extensive application of argumentation logic theory across fields and the evaluation of argumentation standards in various fields. Mathematics and rhetoric have been applied in many fields. Although Tulmin's argumentation logic theory has some limitations, it not only opens the practical turn of contemporary logic, but also makes the logic circle to re-examine the concept of logic. So it can be said that Tulmin's theory of argumentation logic has a profound influence on the research and development of logic.
