【摘要】："新地吏"是指秦統(tǒng)一戰(zhàn)爭(zhēng)中新占領(lǐng)地區(qū)的官吏。從秦原有統(tǒng)轄地區(qū)選派新地吏是秦利用固有官吏進(jìn)行地方政權(quán)建設(shè)的一項(xiàng)制度,既有穩(wěn)定地方的積極一面,也有造成官民矛盾的消極一面。隨著新地政權(quán)的鞏固,推測(cè)此類新地吏將逐漸減少,選用本地人為吏則相應(yīng)增多。秦雖高度重視對(duì)新地的統(tǒng)治,但過(guò)多的編制和嚴(yán)格的任命規(guī)定,往往使新地出現(xiàn)"缺吏"現(xiàn)象。為統(tǒng)一官吏的思想觀念,也為了彌補(bǔ)吏員數(shù)量的不足,"為吏之道"等訓(xùn)吏教材從道德修養(yǎng)方面對(duì)官吏提出要求。但實(shí)際上,律令的執(zhí)行情況才是衡量官吏品德的根本標(biāo)準(zhǔn)。一旦律令貫徹不利,就有可能導(dǎo)致法治的反復(fù)強(qiáng)化,進(jìn)而衍生出暴政。這在秦推行文化整合的過(guò)程中有其突出的表現(xiàn)。
[Abstract]:"New Land officials" refers to the officials in the newly occupied areas in the Qin Dynasty Unification War. The selection and distribution of new land officials from the original areas under the jurisdiction of the Qin Dynasty is a system in which Qin makes use of the inherent officials to carry out the construction of local political power, which has both the positive side of stabilizing the place and the negative side of the contradiction between the officials and the people. With the consolidation of the new regime, it was speculated that such new land officials would gradually decrease, and the selection of local officials would increase accordingly. Qin attached great importance to the rule of Xindi, but the excessive establishment and strict appointment regulations often caused the phenomenon of lack of officials. In order to unify the ideology of the officials and to make up the shortage of the number of the officials, the teaching materials such as "the way of the officials" put forward the demands on the officials from the aspect of moral cultivation. But in fact, the execution of the decree is the basic standard to measure the morality of officials. Once the law is unfavorable, it may lead to the repeated strengthening of the rule of law, and then give rise to tyranny. This in the Qin Dynasty in the process of cultural integration has its outstanding performance.
