【摘要】：本文以吐魯番出土的五至八世紀的租佃契約文書為研究對象,對契約格式中立契日期一項進行調(diào)查分析,從立契日期表述方式和位置變化情況來探析立契日期在契式演變發(fā)展過程中的規(guī)律。 全文分為三個部分。第一部分是概論,主要交代本文的寫作緣由,介紹國內(nèi)外對吐魯番出土租佃契約文書立契日期格式的研究狀況,以及本文的研究內(nèi)容、使用材料的情況、研究方法和研究意義。第二部分對吐魯番出土租佃文書中立契日期進行研究,通過對立契日期調(diào)查表的分析探討租佃契約中立契日期表述方式的套語和位置變化規(guī)律。第三部分是結(jié)語,從立契日期演變規(guī)律中看吐魯番地區(qū)與內(nèi)地聯(lián)系,以及從中透露出的吐魯番地區(qū)鄉(xiāng)規(guī)民約的歷史信息。 通過對吐魯番出土的五到八世紀租佃契約文書中立契日期研究,可以看到立契日期的表述方式分為唐以前的年號干支混合表述方式和唐西州時期的年號表述方式兩種。同時,隨著時間的推移,立契日期書寫位置也發(fā)生變化。在八世紀以前立契日期多書寫于契首。到八世紀,立契日期位置開始后移,出現(xiàn)了位于契約第二項和契約后部的情況,并增加了土地四至的規(guī)定,契約也內(nèi)容更為詳盡。這些契式上的變化是與內(nèi)地相互影響、相互傳承的,契約作為邊疆地區(qū)鄉(xiāng)規(guī)民約的重要內(nèi)容,也維護著當(dāng)?shù)氐纳鐣刃颉?br/>[Abstract]:Based on the five - to - eighth - century lease contract documents unearthed from Turfan , this paper makes an investigation and analysis on the deed date in the contract form , and analyzes the law of the date of the deed in the course of the evolution of the deed .

The thesis is divided into three parts . The first part is an overview . The first part is the author of this paper . It introduces the research status of the date format of the lease contract of Turfan unearthed from home and abroad , as well as the research contents , the research methods and the significance of the research . The second part discusses the change law of the language and position of the lease contract in the lease contract by the analysis of the date questionnaire . The third part is the conclusion .

Based on the study of the deed dates in the five - to - eighth - century lease contract documents unearthed from Turfan , it can be seen that the date of the deed of deed is divided into two types : Tang ' s previous year ' s dry - branch hybrid expression mode and the year ' s expression mode of the period of the Tang . Meanwhile , with the passage of time , the writing position of the deed date changed .
