【摘要】：民間契約文書的搜集和整理是中國社會經(jīng)濟史研究的一個重要方面。契約文書反映了當(dāng)時經(jīng)濟發(fā)展的真實情況，史料價值非常高，具有極其重要的研究意義。本文通過對清代至民國時期福建德化縣土地契約文書的整理和分析，，借鑒前輩學(xué)者的研究成果，對這部分契約文書進行了具體的分類考述。 本文共分四章，第一章主要是闡述了古代契約文書的產(chǎn)生及其發(fā)展過程以及契約文書的特征，同時按照不同的分類標準和方法對契約文書進行了分類，之后又分析了簽訂契約文書的過程和一份完整的契約文書應(yīng)該包含的幾個重要方面。第二章主要對福建德化縣進行了簡要地介紹，主要包括德化縣的歷史沿革、德化縣的封域、及其地形地貌特點、物產(chǎn)等幾個方面。對于契約文書在當(dāng)?shù)氐陌l(fā)展也進行了簡單的介紹，主要涉及德化縣契約文書的形成發(fā)展過程、契約文書的保存方法和當(dāng)?shù)仄跫s文書的顯著特征。第三章是對清代至民國時期德化縣的契約文書進行了具體的分類考述，共分為六個方面進行表述，包括買賣契約文書、找價契約文書、租佃契約文書、佃權(quán)買賣轉(zhuǎn)移契約文書等幾個主要方面，分門別類的進行了整理與分析。經(jīng)過官府與民間在長期的實踐中，不斷地對契約文書的構(gòu)成進行著總結(jié)與完善，契約文書最終形成了相對固定的格式文本。第四章則從交易雙方、中人、土地來源和出賣原因、標的物說明、買賣雙方的權(quán)利與義務(wù)、畫押、立契日期等幾個方面具體闡述了德化契約文書的構(gòu)成要素。
[Abstract]:The collection and collation of folk contract documents is an important aspect of the study of China's social and economic history. The contract documents reflect the real situation of economic development at that time, and the historical data are of very high value. This article through the Qing Dynasty to the Republic of China Fujian Dehua County land contract documents arrangement and analysis, referring to the previous generation of scholars' research results, this part of the contract documents specific classification. This paper is divided into four chapters. The first chapter mainly expounds the origin and development process of the ancient contract documents and the characteristics of the contract documents. At the same time, it classifies the contract documents according to different classification standards and methods. Then it analyzes the process of signing the contract document and several important aspects that a complete contract document should contain. The second chapter mainly introduces Dehua County in Fujian Province briefly, including the history of Dehua County, the seal area of Dehua County. The development of contract documents in the local area is also briefly introduced, mainly involving the formation and development process of Dehua County contract documents. The third chapter is the specific classification of Dehua County contract documents from Qing Dynasty to the Republic of China, which is divided into six aspects, including the sale of contract documents. Several main aspects, such as seeking price contract documents, tenancy contract documents, tenancy rights transfer contract documents and so on, have been sorted out and analyzed. After a long period of practice between the government and the people, The constitution of the contract document has been summarized and perfected continuously, and the contract document has finally formed a relatively fixed format text. Chapter 4th explains the parties to the transaction, the middle person, the source of the land and the reason for the sale, and the subject matter. The rights and obligations of the buyer and seller, the drawing of the contract, the date of the deed, and so on, specifically expound the constituent elements of the Dehua contract document.
