【摘要】：從張家山漢簡《奏讞書》案例看,西漢初年,漢政府確實依據高祖五年詔放免奴婢為庶民,承認漢朝建立前發(fā)生的身份變動;秦末漢初年間,由于戰(zhàn)亂,流亡人口很多。西漢初年,政府一方面鼓勵"不書名數"者著籍,一方面對亡逃者和隱匿戶口者予以嚴厲打擊;高祖九年(前198年)漢政府遷徙六國貴族到關中,并著籍關中,遷徙者的身份已經是"漢民",如果逃回原籍,就是"亡之諸侯",是違法行為;西漢時期,"道"所管轄下的"蠻夷"也是國家的編戶齊民,國家對他們實行有效的管理。如果逃亡,照樣受到法律的懲處。
[Abstract]:In the early years of the Western Han Dynasty, the Han government did release slaves and maidservants for ordinary people in accordance with Gao Zu's edict, and admitted the changes in identity that had occurred before the establishment of the Han Dynasty. During the early years of the late Qin Dynasty and the Han Dynasty, because of the war, there were many exiled people. In the early years of the Western Han Dynasty, on the one hand, the government encouraged those who did not use the number of books to write books; on the other hand, they severely cracked down on those who died, escaped and hid their hukou. The Han government migrated the nobles from the six countries to Guanzhong for nine years (before 1989). The migrants' status was already "Han people". If they fled back to their places of origin, they would be the "dead princes", which was an illegal act. In the Western Han Dynasty, the "barbarians" under the jurisdiction of "Tao" was also the editor of the state, and the state administered them effectively. If they fled, they would still be punished by law.
