【摘要】："識(shí)劫(女冤)案"當(dāng)為秦南郡屬縣上讞的恐s2案。涉案人大夫沛的戶籍屬民籍,家貲接近"大家"水平,家庭經(jīng)濟(jì)類型可視為南郡地區(qū)鄉(xiāng)里豪民多種經(jīng)營(yíng)模式的典型。沛免其奴婢為庶人,免故隸"識(shí)"為"私屬",是當(dāng)時(shí)主人主動(dòng)放免奴婢的鮮活個(gè)案。在被放免之后"占家貲",證明財(cái)產(chǎn)登記制度的上限不會(huì)晚于戰(zhàn)國(guó)末年;放出的貸款需要占貲,可證貨幣亦在財(cái)產(chǎn)登記之列。案件中涉及的"單"是以宗族血緣為基礎(chǔ),以里為單位組織起來(lái)的一種民間組織。這種原生態(tài)的"單"與東漢時(shí)期形形色色的"單"在組織方式與結(jié)社目的上并不一致,故還不足據(jù)以否定歷史上的"單"從血緣到地緣的演進(jìn)路徑。
