【摘要】：行政復(fù)議作為現(xiàn)代民主政治的產(chǎn)物,其在公民日常生活的救濟(jì)中起著至關(guān)重要的作用。行政復(fù)議制度作為公眾維權(quán)的簡(jiǎn)易法律救濟(jì)途徑而存在,為行政機(jī)關(guān)解決行政爭(zhēng)議提供了重要的法律手段。 然而,我國行政復(fù)議制度在社會(huì)生活中的實(shí)際效果卻并不盡如人意,這可能源于對(duì)行政復(fù)議制度的認(rèn)知不足。而日本,作為我國一衣帶水的鄰邦,由于其文化以及歷史的原因,其行政復(fù)議制度的發(fā)展和變革,有其獨(dú)到之處,值得分析。 本文以日本行政復(fù)議制度為研究樣本,通過研究《日本行政不服審查法》的產(chǎn)生和發(fā)展歷史,以及分析其變革,從而總結(jié)日本行政復(fù)議制度中有利于行政復(fù)議功能發(fā)揮的做法,梳理其中可借鑒之處。
[Abstract]:As the product of modern democratic politics, administrative reconsideration plays an important role in the relief of citizens' daily life. As a simple legal remedy for the public to protect their rights, the administrative reconsideration system provides an important legal means for the administrative organs to solve administrative disputes. However, the actual effect of administrative reconsideration system in social life is not satisfactory, which may be due to the lack of understanding of administrative reconsideration system. Japan, as a neighbor of a strip of water in our country, because of its cultural and historical reasons, the development and reform of its administrative reconsideration system is unique and worthy of analysis. This paper takes the Japanese administrative reconsideration system as the research sample, studies the emergence and development history of the Japanese Administrative Review Law, and analyzes its reform, so as to summarize the practices in the Japanese administrative reconsideration system that are beneficial to the administrative reconsideration function, and sort out the points that can be used for reference.
