【摘要】： 本論文是關(guān)于歐洲一體化進(jìn)程中移民政策發(fā)展的理論與實(shí)踐的探討。歐共體／歐盟移民政策的發(fā)展，不僅表現(xiàn)在國(guó)家層面符合成員國(guó)國(guó)情的發(fā)展，還表現(xiàn)在超國(guó)家層面的協(xié)調(diào)與合作，而且這兩個(gè)層面都離不開(kāi)歐洲一體化這一最重要的歷史背景。論文通過(guò)歷史分析、比較研究歐共體／歐盟移民政策制定的歷史背景、制約政策形成的復(fù)雜因素、政策主要內(nèi)容及歷史脈絡(luò)、政策作用影響等，揭示出移民政策的內(nèi)在機(jī)制和發(fā)展趨勢(shì)。 本論文正文共分七章，加上前言和結(jié)論共有九個(gè)部分。在前言中，主要闡述了選題的現(xiàn)實(shí)意義，評(píng)介了國(guó)內(nèi)外有關(guān)歐洲移民政策研究的學(xué)術(shù)動(dòng)態(tài)，并提出了通過(guò)本文的研究工作希望達(dá)到的兩個(gè)目標(biāo)。 第一章，移民概念和移民政策的理論界定。闡明了移民的定義和移民的類(lèi)型，并對(duì)移民政策范疇進(jìn)行了全面闡釋。在理論概念上的界定，主要為后面的研究確立規(guī)范的基礎(chǔ)。 第二章，歐盟移民流向的動(dòng)因分析。首先對(duì)各種派別的國(guó)際移民動(dòng)因理論進(jìn)行了評(píng)介，隨后應(yīng)用“推—拉”理論全面地分析了東部、南部?jī)晒梢泼窳餍纬傻膭?dòng)因。 第三章，歐盟移民控制政策。論述了移民控制的政策基礎(chǔ)，，分析了移民政策控制的外部控制和內(nèi)部控制及其特點(diǎn)。在論述移民控制制度化時(shí)，著重論述了出入境簽證制度和居留就業(yè)許可管理制度。闡述了移民控制條件以及反控制問(wèn)題。 第四章，移民融合政策分析。論述了移民融合的概念，各成員國(guó)對(duì)待移民融合的共識(shí)，以及歸化入籍政策。從歷史與現(xiàn)實(shí)分析了移民被排斥的境況。分析論述了歐盟成員國(guó)移民政策融合的三大代表性模式即差異排斥模式、共和模式、多元文化模式。 第五章，移民輸入國(guó)與移出國(guó)政策協(xié)調(diào)。闡發(fā)了移民系統(tǒng)理論，并對(duì)輸入國(guó)與輸出國(guó)政策協(xié)調(diào)的紐帶移民鏈系進(jìn)行了條分樓析的闡述，集中概括了移民輸入國(guó)與輸出國(guó)政策合作領(lǐng)域以及特點(diǎn)。 第六章，德、法、英國(guó)別移民政策比較。從歷史的縱向發(fā)展闡述了征募勞工時(shí)期、限制性移民政策發(fā)展中，德、法、英三國(guó)移民政策發(fā)展，并通過(guò)分析比較闡述了各國(guó)的政策發(fā)展異同，揭示出各自政策的內(nèi)在實(shí)質(zhì)。 第七章，歐洲一體化進(jìn)程中的移民政策發(fā)展。以歐洲一體化的歷史變遷為背景，分析了移民狀況以及歐共體／歐盟層面移民政策變化。著重論述了20世紀(jì)80年中期以來(lái)歐洲移民政策治理三個(gè)主要策略《申根協(xié)定》、《都柏林公約》、《邊境公約》。分析了隨著一體化的深入擴(kuò)展移民政策決策機(jī)制的發(fā)展。詳細(xì)論述了統(tǒng)一意識(shí)與聯(lián)盟公民的形成發(fā)展，認(rèn)為統(tǒng)一意識(shí)、聯(lián)盟公民是歐盟移民政治的核心，目前聯(lián)盟公民權(quán)不能脫離國(guó)家公民權(quán)而獨(dú)立存在，它只在有限的范圍內(nèi)發(fā)揮一定的作用，聯(lián)盟公民概念應(yīng)隨著一體化的深入而發(fā)展。 結(jié)語(yǔ)：歐盟移民政策展望。為全文的概括并對(duì)歐盟移民政策發(fā)展進(jìn)行了前瞻性論述，分析了影響歐盟邁向統(tǒng)一移民政策進(jìn)程的制約性因素，認(rèn)為歐盟至2004年將制定的統(tǒng)一移民政策并非一攬子解決移民問(wèn)題的全面政策，很大程度上將局限于移民控制政策范疇的統(tǒng)一，至于移民融合政策的協(xié)調(diào)統(tǒng)一，由于涉及成員國(guó)國(guó)家主權(quán)讓渡，與各國(guó)國(guó)家利益切實(shí)關(guān)聯(lián)，很難達(dá)成關(guān)鍵性成果。從長(zhǎng)遠(yuǎn)來(lái)看，歐盟移民政策的發(fā)展和歐盟建設(shè)總體目標(biāo)是密切相關(guān)的，歐洲一體化發(fā)展方向決定著歐盟共同移民政策的統(tǒng)一程度。
[Abstract]:This thesis is about the theory and practice of immigration policy development in the process of European integration.
