【摘要】： 隨著冷戰(zhàn)的和平結束以及全球化浪潮的猛烈沖擊,整個世界范圍內(nèi)的國家都面臨著共同社會轉(zhuǎn)型背景。在過去30年中,世界上許多國家的政治都進行了自由民主化改革,與此同時伴隨著世界范圍內(nèi)的經(jīng)濟貿(mào)易一體化。市場經(jīng)濟的發(fā)展需要自由民主的體制,泰國脫離威權政體向立憲政體的過渡,為經(jīng)濟發(fā)展提供了一個良好的政治和社會空間。貿(mào)易自由化和經(jīng)濟一體化需要政治制度的自由民主,立憲主義是國家走向政治民主化的指導原理,能給予國家經(jīng)濟改革以寬松自由的環(huán)境和民主的制度。立憲主義事實上提供的是一系列公共產(chǎn)品,比如民主、發(fā)展、人權等。 泰國立憲主義的經(jīng)濟功能研究具有深遠的意義,本文對泰國立憲主義的經(jīng)濟功能的作用方式和影響機制進行了探討,從歷史、實證等多個角度對泰國立憲主義的經(jīng)濟功能進行了闡釋。 隨著泰國經(jīng)濟的發(fā)展,泰國社會分化日益嚴重,社會階級對立沖突頻繁。以曼谷為代表的少數(shù)大城市產(chǎn)生了由新興行業(yè)發(fā)展帶來的既得利益階層,新興產(chǎn)業(yè)集團的出現(xiàn)打破了原來的利益格局。泰國立憲主義對經(jīng)濟的影響機制從根源上就是通過平衡泰國不同社會階級和階層的利益,從而致力于社會的穩(wěn)定和經(jīng)濟的發(fā)展。階級利益沖突的根源是經(jīng)濟發(fā)展不平衡,只要泰國能有均衡的經(jīng)濟發(fā)展模式和合理的收入分配方式,社會資源平衡享有,社會階級和階層的利益沖突就會緩和,各階層共同致力于泰國社會和經(jīng)濟的發(fā)展。立憲主義的普及與實現(xiàn),為經(jīng)濟的發(fā)展提供穩(wěn)定的環(huán)境,能夠在一定程度上消除社會階層之間的矛盾,經(jīng)濟增長提供一個自由競爭的氛圍。 泰國立憲主義主要通過兩種作用方式影響經(jīng)濟,一是直接調(diào)整經(jīng)濟法規(guī)政策促進經(jīng)濟發(fā)展。社會經(jīng)濟行為應當納入立憲主義的實踐狀態(tài)即憲政的框架,社會經(jīng)濟制度的安排,尤其是國家參與的經(jīng)濟行動必須是來自于憲政上的安排,不能是國家的“自由”行動。憲政能夠為社會經(jīng)濟行動提供一整套合憲性的經(jīng)濟命令,而這些行動命令的背后是社會契約的合意、共識、授權與支持。在憲政框架中,自由與干預能夠有機平衡,自由主義得到保障,國家實施干預時要受到憲政制約。二是立憲主義是作用于影響經(jīng)濟因素的制度環(huán)境:人文環(huán)境、法制環(huán)境和社會環(huán)境等來激發(fā)人的創(chuàng)造力,進而促進經(jīng)濟因素最大化發(fā)揮自身的潛力和效用。
[Abstract]:With the end of the Cold War and the fierce impact of globalization, the whole world is facing the background of social transformation. In the past 30 years, many countries in the world have carried out liberal and democratic reforms in politics, accompanied by the integration of economic and trade all over the world. The development of market economy needs a free and democratic system. Thailand's transition from autocracy to constitutionalism provides a good political and social space for economic development. Trade liberalization and economic integration need the free democracy of political system. Constitutionalism is the guiding principle for the country to move towards political democratization, and it can give the national economic reform a liberal and free environment and a democratic system. Constitutionalism actually provides a range of public goods, such as democracy, development, and human rights. The study on the economic function of constitutionalism in Thailand is of profound significance. This paper probes into the mode of action and the mechanism of influence of the economic function of constitutionalism in Thailand. The paper explains the economic function of Thai constitutionalism from several angles. With the development of Thai economy, the division of Thai society is becoming more and more serious, and the conflict of social class is frequent. A few big cities represented by Bangkok have created vested interests class brought by the development of emerging industries, and the emergence of emerging industry groups has broken the original interest pattern. The influence mechanism of Thai constitutionalism on economy is to balance the interests of different social classes and strata in Thailand so as to contribute to social stability and economic development. The root of class interest conflict is the imbalance of economic development. As long as Thailand has a balanced economic development model and a reasonable income distribution mode and balanced enjoyment of social resources, the conflict of interests of the social class and stratum will be alleviated. All sectors are committed to the social and economic development of Thailand. The popularization and realization of constitutionalism can provide a stable environment for economic development, eliminate contradictions among social strata to a certain extent, and provide a free competition atmosphere for economic growth. Thai constitutionalism mainly influences the economy through two ways, one is direct adjustment of economic laws and policies to promote economic development. Social economic behavior should be brought into the frame of constitutionalism, and the arrangement of social economic system, especially the economic action of state participation, must come from the arrangement of constitutionalism, not the "free" action of the state. Constitutionalism can provide a whole set of constitutional economic orders for social and economic actions, and behind these action orders are the consensus, authorization and support of social contract. In the framework of constitutionalism, freedom and intervention can be balanced organically, liberalism is guaranteed, and the state is restricted by constitutionalism. Second, constitutionalism is the institutional environment that affects the economic factors: humanistic environment, legal environment and social environment to stimulate human creativity, and then promote economic factors to maximize their potential and utility.
