【摘要】：英國在自由主義思想、自治精神與普通法經(jīng)驗的指導(dǎo)下形成了自己獨特的法治傳統(tǒng)。這些法治傳統(tǒng)推動了英國近代警察制度的生成,并使英國形成了以法治、服務(wù)、地方自治和政治中立等為原則的獨具特色的近代警察制度,也表明警察制度在形成過程中不具有自主性,而是由法治傳統(tǒng)決定了警察制度的特點。而警察制度的發(fā)展在為法治建設(shè)提供保障的同時,又對法治的現(xiàn)實運作提出問題與挑戰(zhàn),以此形成法治傳統(tǒng)與警察制度之間的良性互動,并進而推動國家法治進程的進一步發(fā)展。
[Abstract]:Under the guidance of liberalism, autonomy and common law experience, Britain formed its own unique tradition of rule of law. These traditions of rule of law promoted the formation of modern police system in England, and made Britain form a unique modern police system based on the principles of rule of law, service, local autonomy and political neutrality. It also shows that the police system does not have autonomy in the forming process, but the characteristics of the police system are determined by the tradition of the rule of law. The development of the police system not only provides guarantee for the construction of the rule of law, but also puts forward problems and challenges to the practical operation of the rule of law, thus forming the benign interaction between the tradition of the rule of law and the police system. And then promote the further development of the process of national rule of law.
