【摘要】：本文是關(guān)于歐洲一體化進(jìn)程中在歐盟層面上所產(chǎn)生的共同移民政策的理論與實(shí)踐的探討。隨著歐洲一體化進(jìn)程的不斷深化與擴(kuò)展，歐盟統(tǒng)一的內(nèi)部大市場(chǎng)已初具規(guī)模。內(nèi)部大市場(chǎng)的建立需要人員、物資、商品的自由流通，而人員的自由流通又加劇了外來(lái)移民對(duì)歐盟政治、經(jīng)濟(jì)以及社會(huì)文化的影響，歐盟移民問(wèn)題由此產(chǎn)生。歐盟共同移民政策的制定與發(fā)展，不僅是為了應(yīng)對(duì)不斷加劇的移民問(wèn)題，而且也是歐洲一體化進(jìn)程的主要內(nèi)容之一。本文通過(guò)縱向的歷史分析、橫向的比較分析兩種方法，論述了歐盟共同移民政策制定的必要性、法律基礎(chǔ)、決策機(jī)制、發(fā)展模式及其面對(duì)的挑戰(zhàn)，揭示了歐盟共同移民政策的發(fā)展趨勢(shì)及其與歐洲一體化進(jìn)程的相互作用。 論文正文共分三章，加上引言和結(jié)論共五個(gè)部分。引言部分主要闡述了論文選題的理論意義與現(xiàn)實(shí)意義，分析了國(guó)內(nèi)外學(xué)術(shù)界對(duì)這一問(wèn)題的研究歷史和現(xiàn)狀，并提出了本文的寫作所希望解決的問(wèn)題。 第一章，歐盟移民問(wèn)題的由來(lái)及其具體表現(xiàn)。論述了歐盟移民問(wèn)題產(chǎn)生的原因，主要包括全球化的時(shí)代背景、歷史政策的遺留問(wèn)題、地緣政治性因素以及經(jīng)濟(jì)因素。關(guān)于歐盟移民問(wèn)題的具體表現(xiàn)則主要從移民的存在及其不斷滲入對(duì)歐盟國(guó)家及歐洲一體化進(jìn)程所造成的政治、經(jīng)濟(jì)及社會(huì)影響進(jìn)行論述。 第二章，，歐盟共同移民政策的發(fā)展現(xiàn)狀。首先闡述了歐盟共同移民政策制定與發(fā)展的法律基礎(chǔ)，也即歐洲一體化進(jìn)程中所通過(guò)的一系列政策性條約及協(xié)議對(duì)共同移民政策的基礎(chǔ)性作用。其次對(duì)歐盟治理移民的主要機(jī)制進(jìn)行分析，主要包括歐盟的第三根支柱：司法與內(nèi)部事務(wù)合作、申根系統(tǒng)、《都柏林公約》、特維小組等。緊接著對(duì)共同移民政策的特點(diǎn)及其所要實(shí)現(xiàn)的目標(biāo)進(jìn)行了分析，以此為參照對(duì)歐盟移民治理的三種模式作了評(píng)價(jià)。 第三章，歐盟共同移民政策發(fā)展的制約因素。主要分析了“國(guó)家原教旨主義(state fundamentalism)”對(duì)共同移民政策制定與發(fā)展的影響，這種影響主要是通過(guò)主權(quán)國(guó)家作用于歐盟層面的。 結(jié)論：歐盟共同移民政策展望�？偨Y(jié)全文，并對(duì)歐盟共同移民政策進(jìn)行預(yù)測(cè)性論述，分析了共同移民政策與歐洲一體化進(jìn)程的相互作用。認(rèn)為歐盟的發(fā)展必然要求共同移民政策的不斷完善，但由于國(guó)家主權(quán)的進(jìn)一步讓渡存在困難，以及9·11事件 之后國(guó)際恐J飾主義的不斷泛濫對(duì)國(guó)家安全的負(fù)面影響，超國(guó)家模式的共同移民政策 短期內(nèi)難以實(shí)現(xiàn)，歐盟移民治理仍將為主權(quán)國(guó)家主導(dǎo)下的多層次治理模式。
[Abstract]:This paper discusses the theory and practice of common immigration policy in the process of European integration. With the deepening and expansion of the European integration process, the EU unified internal market has begun to take shape. The establishment of internal market needs the free circulation of people, goods and commodities, and the free circulation of personnel intensifies the influence of immigrants on the politics, economy and social culture of EU. The formulation and development of EU common immigration policy is not only to deal with the growing migration problem, but also one of the main contents of the European integration process. This paper discusses the necessity, the legal basis, the decision-making mechanism, the development model and the challenges faced by the EU common immigration policy through longitudinal historical analysis and horizontal comparative analysis. It reveals the development trend of EU common immigration policy and its interaction with European integration process. The paper is divided into three chapters, plus introduction and conclusion of five parts. The preface mainly expounds the theoretical and practical significance of the topic, analyzes the history and present situation of academic research on this issue at home and abroad, and puts forward the problems to be solved in the writing of this paper. The first chapter, the origin of EU immigration and its specific performance. This paper discusses the causes of EU immigration problems, including the background of globalization, the legacy of historical policies, geopolitical factors and economic factors. The concrete manifestation of EU migration is mainly discussed from the existence of immigrants and the political, economic and social impact on the EU countries and the process of European integration caused by the continuous infiltration of immigrants. The second chapter, the development status of EU Common Migration Policy. First of all, it expounds the legal basis for the formulation and development of EU common immigration policy, that is, a series of policy treaties and agreements adopted in the process of European integration play a fundamental role in the common migration policy. Secondly, it analyzes the main mechanism of EU governing immigration, including the third pillar of EU: judicial and internal affairs cooperation, Schengen system, Dublin Convention, Tevi Group and so on. Then it analyzes the characteristics of Common Migration Policy and its objectives, and evaluates the three models of EU immigration governance. Chapter three, the restrictive factors of the development of EU Common Migration Policy. This paper mainly analyzes the influence of "state fundamentalism" on the formulation and development of common immigration policy, which is mainly influenced by sovereign states at the EU level. Conclusion: European Union Common Migration Policy Outlook. This paper summarizes the full text and analyzes the interaction between the common immigration policy and the process of European integration. It is believed that the development of the European Union is bound to require the continuous improvement of the common immigration policy, but there are difficulties due to the further transfer of national sovereignty, as well as the events of 11 September. The negative impact of the proliferation of international terrorism on national security, the supranational model of common immigration policy Difficult to achieve in the short term, EU immigration governance will remain sovereign-led multi-level governance model.
