【摘要】：自2005年底以來,泰國一直深陷政治危機(jī)之中,到目前已經(jīng)歷了2006年9月和2014年5月兩次政變。這兩次政變深刻暴露出了公民社會和政治體制在政壇中的矛盾作用,其中尤以憲法與憲法法院最為突出。盡管人們普遍希望公民社會和憲制架構(gòu)(constitutional structures)能夠?qū)崿F(xiàn)與選舉授予權(quán)、問責(zé)制和政治權(quán)利密切相關(guān)的民主目標(biāo),但是人們在泰國所目睹的一切卻與此有著天壤之別。公民社會和憲政的參與者一直為黨派利益而非民主價值觀所驅(qū)使。作為2006年和2014年兩次政變的導(dǎo)火索,公民社會的各種勢力強(qiáng)力動員起來,涌上曼谷街頭,試圖推翻民選政府。在此過程中,他們?yōu)檐姺綄?shí)施干預(yù)提供了政治空間和合法性。憲法法院和憲法也在反民主活動中起到了推波助瀾的作用。起草《2007年憲法》就是明擺著要削弱政黨的勢力,恢復(fù)機(jī)構(gòu)割裂的格局,其終極目的是不讓他信·西那瓦(Thaksin Shinawatra)及其陣營重返政壇。憲法法院所宣布的許多判決也同樣反映出政治利益,而非客觀地依法辦事。因此,泰國的民主政體是建立在流沙之上的:人們原本指望一些社會力量和社會制度可以鞏固民主,但是事實(shí)表明,就連他們自己亦對其與民主的關(guān)系深感困惑。
[Abstract]:Since the end of 2005, Thailand has been in the middle of the political crisis and has now experienced two coups in September 2006 and May 2014. The two coups have deeply exposed the contradictory role of civil society and political system in the political arena, especially the Constitution and the constitutional court, even though people generally hope that civil society and constitutional framework are generally expected. Constitutional structures can achieve democratic goals closely related to the right to vote, accountability and political rights, but what people see in Thailand is different from that. Civil society and constitutionalism have been driven by party interests rather than democratic values. The two administration in 2006 and 2014. In the process, they provided political space and legitimacy for the intervention of the military. The constitutional court and the Constitution also played a role in the anti democratic activities. The drafting of the constitution of the <2007 was clear. The ultimate aim of Thaksin Shinawatra (Thaksin Shinawatra) and its camp to return to the political arena is to weaken the political party's power and to return to the political arena. Many of the judgments announced by the constitutional court also reflect the political interests rather than the objective law. Therefore, the democratic regime in Thailand is based on the flow sand: the people are originally the original. It is expected that some social forces and social systems can consolidate democracy, but facts show that even they themselves are deeply puzzled about their relationship with democracy.
