【摘要】："世界侵權(quán)法學(xué)會(huì)"設(shè)計(jì)的"剎車片故障案"、"被感染的血液案"和"橋梁垮塌案"三個(gè)虛構(gòu)案例是為了從不同角度檢驗(yàn)各個(gè)法域缺陷產(chǎn)品責(zé)任的適用范圍和嚴(yán)格性。"合法期待"測(cè)試與"消費(fèi)者期待"測(cè)試存在兩方面的區(qū)別。適用于缺陷問題的"風(fēng)險(xiǎn)—效用"測(cè)試與適用于生產(chǎn)者過錯(cuò)問題的"風(fēng)險(xiǎn)—效用"測(cè)試之間存在重要區(qū)別。單一的理論不能對(duì)嚴(yán)格責(zé)任在現(xiàn)有產(chǎn)品責(zé)任法適用范圍內(nèi)提供正當(dāng)性依據(jù)。產(chǎn)品責(zé)任是包含消費(fèi)者法引以為據(jù)的典型正當(dāng)性事由的自成一格的責(zé)任。對(duì)更廣泛范圍的人提供保護(hù),可以基于普通人對(duì)市場(chǎng)銷售或投入流通的產(chǎn)品不存在安全性方面的缺陷具有合理期待而正當(dāng)化。
[Abstract]:The three fictional cases designed by the World Society of Tort Law, such as "brake brake failure case", "infected blood case" and "bridge collapse case", are designed to test the scope of application and strictness of liability for defective products in different jurisdictions from different angles. Sex. There are two differences between the "legitimate expectation" test and the "consumer expectation" test. There is a relationship between the "risk- utility" test applicable to defects and the "risk- utility" test applicable to producer fault problems. A single theory cannot provide justification for strict liability within the scope of application of the existing product liability law. Product liability is the sole responsibility that contains typical legitimate reasons cited by consumer law. Providing protection to a wider range of people, It can be justified on the basis that ordinary people have reasonable expectations that products sold or put into circulation do not have safety defects.
