【摘要】：在不到十年的時(shí)間中,隨著黑山、科索沃和南蘇丹先后宣布獨(dú)立,蘇格蘭又步了入人們的視線。主權(quán)國家內(nèi)的民族究竟享有怎樣的權(quán)利或權(quán)力?能否享有自決權(quán)?如果可以,這種自決權(quán)的維度是什么?相關(guān)的國際法依據(jù)是什么?本文通過分析蘇格蘭民族主義政治思想理念,探討蘇格蘭民族主義從追求自治到選擇獨(dú)立的理論依據(jù),以期為進(jìn)一步認(rèn)識和理解相關(guān)問題提供參考,為民族政治學(xué)、法學(xué)視閾下的民族主義與民族國家建構(gòu)的深入研究提供現(xiàn)實(shí)案例和理論借鑒。認(rèn)為,蘇格蘭民族主義思想的重要構(gòu)件之間存有張力,其合理性與指導(dǎo)意義尚不能定論。
[Abstract]:In less than a decade, as Montenegro, Kosovo and South Sudan declared their independence, Scotland took another look. What kind of rights or powers does the nation in a sovereign state enjoy? Do you have the right to self-determination? If so, what is the dimension of this right of self-determination? What is the relevant basis of international law? By analyzing the political ideology of Scottish nationalism, this paper probes into the theoretical basis of Scottish nationalism from the pursuit of autonomy to the choice of independence, in order to provide a reference for further understanding and understanding of relevant issues, as well as for national politics. The further study of nationalism and nation-state construction from the perspective of law provides practical cases and theoretical references. It is believed that there is tension between the important components of Scottish nationalist thought and its rationality and guiding significance are still uncertain.
