大學(xué)生被害現(xiàn)象與對(duì)策研究

【摘要】:當(dāng)代大學(xué)生被害的案例時(shí)有發(fā)生。大學(xué)生所遭受的侵害不僅包括財(cái)產(chǎn)損失還包括人身侵害,在一些性質(zhì)惡劣的案件中,大學(xué)生甚至?xí)ド。被害大學(xué)生及被害大學(xué)生周圍的同學(xué)、朋友、親人的生活和學(xué)習(xí)都因此受到了一定程度的影響。犯罪學(xué)理論研究視角的轉(zhuǎn)變及犯罪預(yù)防重點(diǎn)的轉(zhuǎn)變,使得從被害的角度研究犯罪預(yù)防成為犯罪學(xué)研究的重要內(nèi)容。被害預(yù)防理論為大學(xué)生被害研究的理論基礎(chǔ)。大學(xué)生作為一個(gè)群體呈現(xiàn)出不同的被害性,本文以被害理論為基礎(chǔ)探尋大學(xué)生被害預(yù)防體系和大學(xué)生被害預(yù)防的具體措施。 大學(xué)生是社會(huì)上的一個(gè)特殊群體,接受過大學(xué)教育的人,作為新思想的前沿群體、社會(huì)新技術(shù)、國家培養(yǎng)的高級(jí)專門人才,包括國家統(tǒng)招的在校學(xué)生,即大專生、本科生、碩士、博士等。目前,大學(xué)生被害的現(xiàn)象時(shí)有發(fā)生。大學(xué)生被害,即在我國各級(jí)各類高校接受高等教育在讀的學(xué)生因?yàn)榉缸、一般違法行為的侵害而導(dǎo)致的情感痛苦、經(jīng)濟(jì)損失、身心損失或基本權(quán)利的重大損害。從收集到的資料來看,大學(xué)生被害呈現(xiàn)出大學(xué)生被害社會(huì)負(fù)面影響大、被害類型多樣化、反復(fù)被害、大學(xué)生被害人防害意識(shí)薄弱、大學(xué)生缺乏預(yù)防教育和技能培訓(xùn)的特點(diǎn)。 大學(xué)生被害類型多樣化的特點(diǎn)反映出大學(xué)生被害的情景較為復(fù)雜,只有經(jīng)過實(shí)證的調(diào)查研究才能對(duì)大學(xué)生被害的情況從整體上進(jìn)行把握,從而更加理性的認(rèn)識(shí)大學(xué)生被害。一方面,通過在校大學(xué)生被害問卷調(diào)查的形式,了解大學(xué)生被害的總體分析;另一方面,根據(jù)收集的案卷材料,分析大學(xué)生常見被害類型的特點(diǎn)。大學(xué)生常見的被害類型有盜竊被害、性受害、暴力被害、搶劫被害等。 在被害發(fā)生的過程中,大學(xué)生自身存在的一些主客觀因素會(huì)影響、刺激犯罪的發(fā)生,即大學(xué)生的被害性。大學(xué)生作為社會(huì)人的一部分,肯定會(huì)具有一般人所具有的一些被害性,但大學(xué)生也有自身的特別之處,例如,心理不成熟、活動(dòng)場(chǎng)所特別、行為規(guī)律性等。因此,研究大學(xué)生被害性有其必要性。在客觀方面,大學(xué)生的被害性主要表現(xiàn)在性別、年齡、社會(huì)階層三方面;在主觀方面,大學(xué)生的被害性主要表現(xiàn)在心理、行為方面。 大學(xué)生被害性的研究為大學(xué)生被害預(yù)防具體措施的研究提供了依據(jù)。另外,被害預(yù)防是一個(gè)有機(jī)統(tǒng)一的整體,大學(xué)生被害預(yù)防作為被害預(yù)防的一部分也應(yīng)該是一個(gè)有機(jī)統(tǒng)一的整體。大學(xué)生被害預(yù)防體系是指以個(gè)體被害預(yù)防為主、以高校犯罪預(yù)防為輔、以高發(fā)罪案?jìng)(gè)別預(yù)防為重點(diǎn)的綜合預(yù)防被害體系。以此作為大學(xué)生被害預(yù)防的線索,在大學(xué)生被害預(yù)防的體系內(nèi),依據(jù)大學(xué)生的被害性,以被害過程作為分界點(diǎn),即被害前、被害中、被害后,提出具體的預(yù)防措施。
[Abstract]:Contemporary college students are killed from time to time. The infringement suffered by college students includes not only property damage but also personal infringement. In some cases of bad nature, college students will even lose their lives. The life and study of the murdered college students and the students, friends and relatives around the murdered college students have been affected to a certain extent. With the change of the perspective of criminology theory and the focus of crime prevention, the study of crime prevention from the perspective of murder has become an important part of criminology. The theory of victim prevention is the theoretical basis of the study of college students' murder. College students as a group show different victimization. Based on the theory of victimization, this paper explores the system of college students' victimization prevention and the concrete measures of college students' victimization prevention. College students are a special group in society. People who have received university education, as the frontier group of new ideas, new social technology, senior specialized personnel trained by the state, including students recruited by the state, that is, college students, undergraduates, masters, doctorates, and so on. At present, the phenomenon of college students being killed occurs from time to time. College students are killed, that is, the emotional pain, economic loss, physical and mental loss or great damage of basic rights caused by the infringement of crime and general illegal behavior by students in higher education at all levels and all kinds of colleges and universities in our country. From the collected data, the victimization of college students shows the characteristics of great negative social influence, diversified types of victimization, repeated victimization, weak awareness of victim prevention, and lack of preventive education and skill training for college students. The diversified characteristics of the killing types of college students reflect that the situation of college students being killed is more complex. Only through empirical investigation and research can we grasp the situation of college students as a whole, so as to understand the murder of college students more rationally. On the one hand, through the form of questionnaire survey of college students, we can understand the overall analysis of the murder of college students; on the other hand, according to the collected case files, analyze the characteristics of common types of murder of college students. The common types of college students are theft, sexual victimization, violence, robbery and so on. In the process of being killed, some subjective and objective factors existing in college students themselves will affect and stimulate the occurrence of crime, that is, the victimization of college students. As a part of society, college students will certainly have some of the harm that ordinary people have, but college students also have their own special features, such as psychological immaturity, special places of activity, behavior regularity and so on. Therefore, it is necessary to study the victimization of college students. In the objective aspect, the passivity of college students is mainly manifested in three aspects: gender, age and social class, and in subjective aspect, the passivity of college students is mainly manifested in psychology and behavior. The study of college students' victimization provides a basis for the study of specific measures to prevent college students from being killed. In addition, the prevention of being killed is an organic unified whole, and the prevention of college students as a part of the prevention of being killed should also be an organic and unified whole. The prevention system of college students' victimization refers to the comprehensive prevention system, which is mainly based on individual murder prevention, supplemented by crime prevention in colleges and universities, and focuses on individual prevention of high incidence of crimes. Taking this as the clue of college students' victimization prevention, according to the victimization of college students, the process of being killed is taken as the dividing point, that is, before being killed, in the course of being killed, and after being killed, the concrete preventive measures are put forward.
