【摘要】：勞動教養(yǎng)制度是我國特定歷史條件創(chuàng)設(shè)的一種法律制度。但是隨著社會的發(fā)展,在長期的實踐過程中,由于立法規(guī)定的疏忽,尤其是程序規(guī)范的缺損,勞動教養(yǎng)制度在實施中存在諸多問題,其合法性、合理性和正當(dāng)性不斷受到質(zhì)疑。筆者分析勞動教養(yǎng)制度的弊端,并提出自己的改革方案的見解。 本文第一章為緒論部分,主要論述了論文的選題目的和意義、文獻(xiàn)綜述、研究方法、創(chuàng)新點以及文章結(jié)構(gòu)；第二章勞動教養(yǎng)制度概述,首先闡述勞動教養(yǎng)制度的概念、性質(zhì)以及歷史沿革,其次介紹國外勞動教養(yǎng)制度；第三章我國勞動教養(yǎng)制度的現(xiàn)狀及缺陷,主要分析分析這個制度的現(xiàn)實狀態(tài)、提出存在的缺陷；第四章勞動教養(yǎng)制度與人權(quán)保障,簡單闡述了勞動教養(yǎng)與人權(quán)保障之間的關(guān)系,而后分析勞動教養(yǎng)制度與相關(guān)人權(quán)公約的沖突；第五章改造勞動教養(yǎng)制度之爭,重點介紹學(xué)術(shù)界對于勞動教養(yǎng)制度的不同看法,從是否應(yīng)當(dāng)保留勞動教養(yǎng)制度到如何改造這一制度；第六章勞動教養(yǎng)制度之重構(gòu),通過以上幾章的分析和論述,提出改造勞動教養(yǎng)制度的可行性建議。結(jié)論部分是對本文的總結(jié)及對我國勞動教養(yǎng)制度的展望。
[Abstract]:The system of reeducation through labor is a kind of legal system created by specific historical conditions in our country. However, with the development of society, in the process of long-term practice, due to the negligence of legislative provisions, especially the defect of procedural norms, there are many problems in the implementation of the reeducation through labor system, and its legitimacy, rationality and legitimacy are constantly being questioned. The author analyzes the drawbacks of the reeducation through labor system and puts forward his own views on the reform plan. The first chapter is the introduction, which mainly discusses the purpose and significance of the topic, literature review, research methods, innovation and the structure of the article. The second chapter is an overview of the reeducation through labor system, which first expounds the concept, nature and historical evolution of the reeducation through labor system, and then introduces the reeducation through labor system in foreign countries. The third chapter is the present situation and defects of the reeducation through labor system in our country, mainly analyzes the realistic state of this system, and puts forward the existing defects. The fourth chapter is about the relationship between reeducation through labor and human rights protection, and then analyzes the conflict between the reeducation through labor system and the relevant human rights conventions. The fifth chapter is about the dispute of reforming the reeducation through labor system, focusing on the different views of the academic circles on the reeducation through labor system, from whether the reeducation through labor system should be retained or not to how to reform it. The sixth chapter is the reconstruction of the reeducation through labor system, through the analysis and discussion of the above chapters, the feasibility suggestions of reforming the reeducation through labor system are put forward. The conclusion part is the summary of this paper and the prospect of reeducation through labor system in our country.
