【摘要】： 社區(qū)矯正是一種不使罪犯與社會隔離并利用社區(qū)資源教育改造罪犯的方法,是所有在社區(qū)環(huán)境中管理教育罪犯方式的總稱,有的國家稱之為“社區(qū)矯治”。它是一種與監(jiān)獄矯正相對的行刑方式,是世界各國行刑制度社會化趨勢的一個主要體現(xiàn),隨著刑罰執(zhí)行理念從簡單的懲罰到教育的轉(zhuǎn)變,隨著個別預防理論和教育刑理論在刑罰執(zhí)行領域主導地位的確立,社區(qū)矯正這種非監(jiān)禁式,開放性的罪犯矯正方式越來越受到世界各國的重視。我國理論、實務界對社區(qū)矯正進行了有益的探索,在部分省市進行了試點并取得了一定的成效。 本文介紹了我國社區(qū)矯正制度試點推廣情況,列舉了我國目前社區(qū)矯正制度中國化所面臨的問題并對其原因進行了分析,試圖就如何完善和構(gòu)建我國社區(qū)矯正制度進行了有益的探索,針對目前我國推廣社區(qū)矯正制度中存在的問題和不足,提出自己的看法。本文第一章介紹了我國社區(qū)矯正制度的現(xiàn)狀,包括我國各地實行社區(qū)矯正制度概況和實行社區(qū)矯正制度的積極影響;第二章介紹了我國實行社區(qū)矯正制度存在的問題并對其原因進行了分析;第三章針對我國社區(qū)矯正制度存在的問題及其原因,提出了完善我國社區(qū)矯正制度的構(gòu)想。包括:確立非監(jiān)禁刑和監(jiān)禁刑并重的刑罰理念、完善社區(qū)矯正法律法規(guī)、提高社區(qū)矯正在刑罰執(zhí)行體系中的地位、加強專門的社區(qū)矯正機構(gòu)建設、制定切實可行的財政保障措施及完善社區(qū)矯正的監(jiān)管方式等。
[Abstract]:Community correction is a method of not isolating criminals from society and using community resources to educate and reform criminals. It is the general name of all the ways of managing and educating criminals in community environment. Some countries call it "community correction". It is a kind of execution mode opposite to prison correction, and it is a main embodiment of the socialization trend of execution system in the world. With the transformation of the concept of penalty execution from simple punishment to education, With the establishment of individual prevention theory and educational penalty theory in the field of penalty execution, community correction is a kind of non-prison, open criminal correction has been paid more and more attention by all countries in the world. The theory and practice circle of our country have carried on the beneficial exploration to the community correction, have carried on the pilot experiment in some provinces and cities and have obtained the certain effect. This paper introduces the pilot promotion of community correction system in China, enumerates the problems faced by the Sinicization of community correction system in China at present, and analyzes the reasons for it. This paper attempts to make a beneficial exploration on how to perfect and construct the community correction system in our country, and puts forward its own views in view of the problems and shortcomings existing in the promotion of the community correction system in our country at present. The first chapter of this paper introduces the status quo of community correction system in China, including the general situation of the implementation of community correction system and the positive impact of the implementation of community correction system in various parts of our country. The second chapter introduces the problems existing in the implementation of community correction system in our country and analyzes its reasons; the third chapter puts forward the idea of perfecting the community correction system in our country in view of the existing problems and causes of community correction system in our country. Including: establishing the penalty concept of both non-imprisonment penalty and imprisonment penalty, perfecting the laws and regulations of community correction, improving the position of community correction in the penalty execution system, strengthening the construction of special community correction institutions, Establish practical financial protection measures and improve the supervision of community correction, and so on.
