【摘要】：近年來(lái),隨著中國(guó)女性犯罪數(shù)量的不斷上升,女性犯罪已經(jīng)成為中國(guó)社會(huì)不容忽視的問(wèn)題,對(duì)于女性犯罪的原因探討和預(yù)防策略研究已成為一個(gè)受到廣泛關(guān)注的熱點(diǎn)。本文就是從社會(huì)需要出發(fā),在犯罪社會(huì)學(xué)理論的指導(dǎo)下,闡述了當(dāng)前我國(guó)女性犯罪的一些理論問(wèn)題。 全文共分為四個(gè)部分: 第一部分,首先以回顧國(guó)內(nèi)外女性犯罪研究的歷史為起點(diǎn),對(duì)女性犯罪研究的歷史進(jìn)行了簡(jiǎn)要評(píng)述;然后通過(guò)對(duì)女性犯罪原因的剖析提出了我國(guó)女性犯罪研究的理論視角,即借鑒犯罪社會(huì)學(xué)的理論觀點(diǎn)和女性的社會(huì)角色特征,并結(jié)合我國(guó)社會(huì)轉(zhuǎn)型時(shí)期的特殊國(guó)情,對(duì)女性犯罪問(wèn)題進(jìn)行理論上的探索。 第二部分,探討轉(zhuǎn)型期中國(guó)女性犯罪的微觀社會(huì)原因,從家庭、學(xué)校、不良交往三個(gè)方面展開(kāi)了論述。家庭對(duì)女性犯罪的影響包括家庭教育失當(dāng)和家庭關(guān)系失和兩大因素,其中,家庭教育失當(dāng)主要體現(xiàn)在家庭教育功能受挫、家庭教育方法不當(dāng)、父母行為不檢點(diǎn)三個(gè)方面;家庭關(guān)系失和主要體現(xiàn)在家庭暴力和畸形家庭兩個(gè)方面。學(xué)校對(duì)女性犯罪的影響包括教育方法不正確和教育內(nèi)容不科學(xué)兩大因素,其中,教育方法不正確主要體現(xiàn)在對(duì)學(xué)生評(píng)價(jià)標(biāo)準(zhǔn)單一、對(duì)“差生”管教不力、學(xué)校教育與家庭教育脫節(jié)三個(gè)方面;教育內(nèi)容不科學(xué)主要體現(xiàn)在重智育輕德育、性知識(shí)教育不到位、法制教育不完善三個(gè)方面。不良交往對(duì)女性犯罪的影響包括不良交往對(duì)象和不良交往場(chǎng)所兩大因素,其中,不良交往對(duì)象主要體現(xiàn)在不良交往個(gè)體和不良交往群體兩個(gè)方面;不良交往場(chǎng)所主要體現(xiàn)在不健康娛樂(lè)場(chǎng)所和網(wǎng)絡(luò)兩個(gè)方面。 第三部分,分析轉(zhuǎn)型期女性犯罪的宏觀社會(huì)原因,從社會(huì)變遷、社會(huì)文化兩個(gè)角度進(jìn)行了闡述。社會(huì)變遷對(duì)女性犯罪的影響包括社會(huì)地位變化、經(jīng)濟(jì)因素影響、社會(huì)角色轉(zhuǎn)變和人口流動(dòng)加速四大要素。社會(huì)地位變化主要體現(xiàn)在女性就業(yè)邊緣化和女性商品化兩個(gè)方面;經(jīng)濟(jì)因素影響主要體現(xiàn)在經(jīng)濟(jì)體制存在漏洞、市場(chǎng)經(jīng)濟(jì)的負(fù)面影響和女性相對(duì)貧困化三個(gè)方面;社會(huì)角色轉(zhuǎn)變主要體現(xiàn)在傳統(tǒng)女性角色和現(xiàn)代角色要求的碰撞;人口流動(dòng)加速主要體現(xiàn)在流動(dòng)女性和“留守”女性兩種情形。社會(huì)文化對(duì)女性犯罪的影響包括文化沖突和文化傳播兩大因素,其中,文化沖突主要體現(xiàn)在異質(zhì)文化沖突、傳統(tǒng)文化和現(xiàn)代文化沖突兩個(gè)方面;文化傳播主要體現(xiàn)在不良文化傳播和“信息爆炸”的負(fù)效應(yīng)兩個(gè)方面。
[Abstract]:In recent years, with the increasing number of female crime in China, female crime has become a problem that can not be ignored in Chinese society. The research on the causes and prevention strategies of female crime has become a hot topic which has been paid more and more attention to. Under the guidance of the sociological theory of crime, this paper expounds some theoretical problems of female crime in our country at present, according to the needs of the society and under the guidance of the sociological theory of crime. The full text is divided into four parts: the first part is to review the history of the study of female crime at home and abroad, and make a brief comment on the history of the study of female crime; Then, through the analysis of the causes of female crime, this paper puts forward the theoretical perspective of the study of female crime in China, that is, drawing lessons from the theoretical point of view of sociology of crime and the characteristics of women's social role, and combining with the special national conditions in the period of social transformation in China. To the female crime problem carries on the theoretical exploration. The second part discusses the micro-social reasons of Chinese female crime in transition period, including family, school and bad communication. The influence of family on female crime includes two factors: improper family education and family relationship. Among them, family education malpractice is mainly reflected in three aspects: frustration of family education function, improper method of family education and improper behavior of parents. The loss of family relationship is mainly reflected in two aspects: domestic violence and abnormal family. The influence of school on female crime includes two major factors: incorrect educational method and unscientific educational content. Among them, the incorrect educational method is mainly reflected in the single evaluation criteria for students and the lack of discipline for "poor students". The separation of school education and family education; The unscientific content of education is mainly embodied in three aspects: emphasizing intelligence education over moral education, sex knowledge education is not in place, and legal education is not perfect. The influence of bad communication on female crime includes two major factors: the object of bad communication and the place of bad communication. Among them, the object of bad communication is mainly reflected in two aspects: the individual of bad communication and the group of bad communication. Unhealthy communication places are mainly reflected in unhealthy entertainment places and the two aspects of the network. The third part analyzes the macro-social reasons of female crime in the transitional period, and expounds it from two angles: social change and social culture. The influence of social change on female crime includes the change of social status, the influence of economic factors, the change of social role and the acceleration of population flow. The social status changes are mainly reflected in the marginalization of female employment and the commercialization of women, the economic factors are mainly reflected in the existence of loopholes in the economic system, the negative impact of the market economy and the relative poverty of women; The social role change is mainly reflected in the collision between the traditional female role and the modern role requirement, and the acceleration of the population movement is mainly reflected in the floating women and the "left behind" women. The influence of social culture on female crime includes two major factors: cultural conflict and cultural communication, in which cultural conflict is mainly reflected in heterogeneous cultural conflict, traditional culture and modern cultural conflict. Cultural communication is mainly reflected in the negative effects of bad cultural communication and "information explosion".
