上海境外人員管理問(wèn)題研究

【摘要】: 我國(guó)的出入境管理運(yùn)作機(jī)制屬于現(xiàn)代警務(wù)運(yùn)作機(jī)制的一部分,而境外人員管理是國(guó)家行政管理的組成部分,是我國(guó)公安機(jī)關(guān)的一項(xiàng)專(zhuān)門(mén)業(yè)務(wù)。在西部大開(kāi)發(fā)的步伐加快,改革開(kāi)放形勢(shì)的深入發(fā)展和我國(guó)加入WTO的新形勢(shì)下,來(lái)上海居住、從事商務(wù)、旅游等活動(dòng)的境外人員不斷增多,涉外警務(wù)的比重不斷增加,境外人員的管理工作日益繁重和嚴(yán)峻,并暴露出多方面的不足和缺陷,表現(xiàn)在:有效的涉外案件處置和安全防范的整體機(jī)制還未完全形成,僅有的工作機(jī)制運(yùn)作不到位,境外人員屬地化管理的力度不大,涉外法律法規(guī)和技術(shù)手段都不夠完善甚至落后。 本文基于新公共服務(wù)理論,針對(duì)當(dāng)前涉外管理的現(xiàn)狀和不足,直面涉外管理的挑戰(zhàn),抓住亟需提高的幾個(gè)方面,積極思考上海出入境管理工作,提出加強(qiáng)公安機(jī)關(guān)公共服務(wù)能力建設(shè),充分發(fā)揮我國(guó)警察公共服務(wù)職能,從而完善上海境外人員管理工作對(duì)策的主張。具體到本文所要探討的上海境外人員管理問(wèn)題,筆者認(rèn)為只有堅(jiān)持開(kāi)拓創(chuàng)新,深入推進(jìn)公共服務(wù)能力建設(shè),才能充分發(fā)揮公安機(jī)關(guān)境外人員管理的公共服務(wù)職能。 基于目前數(shù)目龐大的外國(guó)人和外國(guó)機(jī)構(gòu),只有將境外人員管理工作的各項(xiàng)措施落實(shí)到基層派出所才能產(chǎn)生和發(fā)揮公安管理的整體效應(yīng),切實(shí)有效地解決管理失控問(wèn)題;對(duì)境外人員的管理要發(fā)揮基層派出所的優(yōu)勢(shì),實(shí)行屬地管理。 針對(duì)管理中遇到的實(shí)際困難,以及管理國(guó)際化程度、透明度原則和自身業(yè)務(wù)素質(zhì)提高的要求,公安機(jī)關(guān)的涉外執(zhí)法水平亟待提高,加強(qiáng)國(guó)際警務(wù)合作刻不容緩,更重要的是社區(qū)管理的理念要充分高效地貫徹執(zhí)行。 對(duì)境外人員的管理還應(yīng)該注意完善出入境管理法律、法規(guī)這個(gè)方面。重點(diǎn)是認(rèn)真研究加入WTO后出現(xiàn)的新情況,結(jié)合WTO的有關(guān)原則和國(guó)際慣例,制訂有關(guān)涉外法律、法規(guī),以填補(bǔ)公安立法的空白。特別是在金融貿(mào)易領(lǐng)域、跨國(guó)犯罪領(lǐng)域、涉外領(lǐng)域、旅游市場(chǎng)已出現(xiàn)公安執(zhí)法的盲區(qū)。
[Abstract]:The operation mechanism of entry-exit management in China is a part of the modern police operation mechanism, while the management of foreign personnel is a part of the national administration and a special business of the public security organs of our country. Under the accelerated pace of the western development, the deepening development of the reform and opening-up situation, and the new situation of China's accession to the WTO, the number of overseas personnel who come to Shanghai to live, engage in business, tourism, and other activities continues to increase, and the proportion of foreign-related police affairs continues to increase. The management of overseas personnel has become increasingly onerous and severe, and has exposed many deficiencies and shortcomings, as manifested in: the overall mechanism of effective handling of foreign-related cases and security prevention has not yet been fully formed, and the only working mechanism is not functioning in place. Foreign personnel localization management is not strong, foreign-related laws and regulations and technical means are not perfect or even backward. Based on the new public service theory, aiming at the current situation and deficiency of foreign-related management, this paper directly faces the challenge of foreign-related management, grasps several aspects that need to be improved, and actively ponders the work of entry-exit management in Shanghai. This paper puts forward the idea of strengthening the construction of public service capacity of public security organs and giving full play to the public service function of police in our country so as to perfect the management of personnel outside Shanghai. In order to give full play to the public service function of the personnel management outside the public security organs, the author thinks that only by persisting in innovation and carrying out the construction of public service ability, the author thinks that the management of personnel outside Shanghai should be discussed in this paper. Based on the large number of foreigners and foreign organizations at present, it is only by implementing the measures of management of foreign personnel to the grass-roots police stations that the overall effect of public security management can be brought into play and the problem of out-of-control management can be solved effectively. The management of overseas personnel should give full play to the advantages of grass-roots police stations and carry out territorial management. In view of the practical difficulties encountered in management, as well as the requirements of the degree of internationalization of management, the principle of transparency and the improvement of their professional qualities, the level of law enforcement concerning foreign affairs of the public security organs needs to be improved urgently, and it is urgent to strengthen international police cooperation. More importantly, the concept of community management should be fully and efficiently implemented. Foreign personnel management should also pay attention to the improvement of immigration management laws, regulations and this aspect. In order to fill the gap of public security legislation, the emphasis is to carefully study the new situation after China's entry into the WTO, and to draw up laws and regulations concerning foreign affairs in the light of the relevant principles and international practices of WTO. Especially in the field of finance and trade, transnational crime, foreign-related fields, the tourism market has appeared blind areas of public security law enforcement.
