殘疾人犯罪的成因及對(duì)策研究

【摘要】： 據(jù)統(tǒng)計(jì),全世界共有5億多的殘疾人,而我國目前各類殘疾人的總數(shù)已經(jīng)達(dá)到了6000多萬,約占全國總?cè)丝诘?%,涉及到全國五分之一的家庭。殘疾人由于生理、心理等多方面的原因,在現(xiàn)代社會(huì)激烈的競爭中往往會(huì)處于弱勢的地位,由此人們更多的是給予同情和對(duì)其工作、生活的關(guān)注。但近年來,殘疾人犯罪案件在全國范圍內(nèi)呈高發(fā)態(tài)勢,不僅在發(fā)案數(shù)量上逐年猛增,而且犯罪類型多樣化,更有向暴力化、有組織犯罪化發(fā)展的趨勢。由此引發(fā)的一系列社會(huì)問題給正處于轉(zhuǎn)型期的我國社會(huì)的穩(wěn)定和發(fā)展造成了巨大的影響,同時(shí)也引起了司法實(shí)務(wù)部門和法律理論界的關(guān)注。 本文從殘疾人的生理、心理等特點(diǎn)入手,并結(jié)合我國的特定社會(huì)歷史條件和文化背景,通過大量統(tǒng)計(jì)數(shù)據(jù)和案例材料,力圖較為深入地分析、探討我國殘疾人犯罪的現(xiàn)狀、特點(diǎn)、原因及其防治對(duì)策。本文對(duì)殘疾人犯罪的原因和預(yù)防對(duì)策著筆較多,對(duì)我國刑法中殘疾人刑事責(zé)任的完善、殘疾犯罪人的心理矯治、殘疾人刑事司法工作體系的構(gòu)建等方面,提出了較為獨(dú)到的見解。本文除導(dǎo)言外,共分四個(gè)部分。 導(dǎo)言部分,簡單論述防治殘疾人人犯罪的重要現(xiàn)實(shí)意義。 正文分為四章。第一章殘疾人犯罪概述,首先對(duì)殘疾人犯罪的概念和范圍進(jìn)行了界定,然后對(duì)我國和世界各國刑法中殘疾人刑事責(zé)任的規(guī)定進(jìn)行比較,并針對(duì)我國刑法中相關(guān)規(guī)定的局限性提出完善意見。 第二章殘疾人犯罪的現(xiàn)狀和特點(diǎn),運(yùn)用大量的統(tǒng)計(jì)數(shù)據(jù)和現(xiàn)實(shí)案例,較為詳細(xì)地分析了我國殘疾人犯罪的基本現(xiàn)狀、類型與特點(diǎn)。 第三章我國殘疾人犯罪原因,從社會(huì)、教育、個(gè)體、被害人等方面入手,深入分析了導(dǎo)致殘疾人犯罪特有的原因。 第四章殘疾人犯罪的對(duì)策,結(jié)合殘疾人犯罪的原因,著重強(qiáng)調(diào)了加強(qiáng)社會(huì)保障和扶持、加強(qiáng)犯罪殘疾人心理矯治對(duì)預(yù)防殘疾人犯罪的意義,并對(duì)殘疾人犯罪的刑事打擊原則、殘疾人刑事司法工作體系的構(gòu)建等方面進(jìn)行了深入的探討。
[Abstract]:According to statistics, there are more than 500 million disabled people in the world, and the total number of disabled persons in China has reached more than 60 million, accounting for about 5% of the total population of the country, involving 1/5 families in the whole country. Because of many reasons, such as physiology, psychology and so on, the disabled are often in a weak position in the fierce competition in modern society, so people pay more attention to their work and life. However, in recent years, the crime cases of the disabled have a high incidence in the whole country, not only in the number of cases increased year by year, but also in the diversification of crime types, more violent, organized crime development trend. A series of social problems have caused great influence on the social stability and development of our country in the transition period, and have also aroused the attention of the judicial practice departments and the legal theorists. Starting with the physiological and psychological characteristics of the disabled, and combining the specific social and historical conditions and cultural background of our country, through a large number of statistical data and case materials, this paper tries to make a more in-depth analysis and probe into the present situation of the crime of the disabled in China. Characteristics, causes and preventive measures. This paper focuses on the causes and preventive measures of the crime of the disabled, the perfection of the criminal liability of the disabled in our criminal law, the psychological correction of the disabled offenders, the construction of the criminal justice system for the disabled, etc. A more original opinion is put forward. In addition to the introduction, this paper is divided into four parts. In the introduction part, it briefly discusses the important practical significance of preventing and controlling crimes committed by persons with disabilities. The text is divided into four chapters. The first chapter is an overview of crimes against persons with disabilities. Firstly, it defines the concept and scope of crimes committed by persons with disabilities, and then compares the criminal liability of persons with disabilities in criminal law between China and other countries around the world. And the limitations of the relevant provisions in the criminal law of our country put forward some suggestions. The second chapter analyzes the basic status, types and characteristics of the crime of the disabled in China by using a large number of statistical data and practical cases. The third chapter analyzes the causes of the crime of the disabled in China from the aspects of society, education, individual, victim and so on. The fourth chapter is the countermeasures of the crime of the disabled, combining the reasons of the crime with the disabled, emphasizing the significance of strengthening the social security and support, strengthening the psychological correction of the crime of the disabled to prevent the crime of the disabled, and the principle of the criminal attack on the crime of the disabled. The construction of the criminal justice system for the disabled is discussed in depth.
