【摘要】： 本文行文3.5萬余字，分三個部分對勞動教養(yǎng)刑法化進行了探析。 第一部分：勞動教養(yǎng)刑法化與我國勞動教養(yǎng)制度改革。首先分析介紹勞動教養(yǎng)刑法化涵義、性質(zhì)以及世界性刑法化改革運動與非刑罰方法興起情況，接著闡述了我國勞動教養(yǎng)制度性質(zhì)、現(xiàn)狀及存在問題，最后在此基礎(chǔ)上論述了勞動教養(yǎng)制度改革出路在于勞動教養(yǎng)刑法化，并進一步探討了勞動教養(yǎng)刑法化的必要性及意義。 第二部分：勞動教養(yǎng)刑法化根據(jù)。分別闡明了勞動教養(yǎng)刑法化理論上的根據(jù)、現(xiàn)實上的根據(jù)和法律上的根據(jù)。其理論根據(jù)主要從防衛(wèi)社會的現(xiàn)實使命，刑事責(zé)任多元化，，犯罪類型多樣化等方面進行說明。現(xiàn)實根據(jù)主要從物質(zhì)基礎(chǔ)、觀念基礎(chǔ)和外部環(huán)境等幾方面論證說明了勞動教養(yǎng)刑法化條件基本具備，時機已基本成熟。并對其法律根據(jù)進行了分析說明。 第三部分：我國勞動教養(yǎng)刑法化制度構(gòu)造。在對勞動教養(yǎng)刑事立法化三種模式進行比較分析的基礎(chǔ)上，闡述了只有單獨立法才是對勞動教養(yǎng)刑事立法化模式的科學(xué)定位。又從法的名稱、法的內(nèi)容幾個方面對勞動教養(yǎng)刑事立法化進行了設(shè)計，從而對勞動教養(yǎng)刑法化進行了較為理想的構(gòu)思。
[Abstract]:This article 35000 words, divided into three parts of the re-education through labor to analyze the criminal law. The first part: reeducation through labor criminal law and our country reeducation through labor system reform. Firstly, it introduces the meaning and nature of reeducation through labor law and the rise of the worldwide criminal reform movement and non-penalty methods, then expounds the nature, present situation and existing problems of the system of reeducation through labor in China. Finally, the author discusses that the way out of the reform of reeducation through labor system lies in the legalization of reeducation through labor, and further discusses the necessity and significance of the legalization of reeducation through labor. The second part: the criminal basis of reeducation through labor. It clarifies the theoretical basis, the practical basis and the legal basis of the reeducation through labor law. Its theoretical basis mainly from the defense society's realistic mission, the criminal responsibility diversification, the crime type diversification and so on aspect carries on the explanation. The realistic basis mainly demonstrates from the material foundation, the idea foundation and the external environment, and so on several aspects demonstrated that the reeducation through labor criminal law condition basically has, the time has basically matured. And its legal basis is analyzed and explained. The third part: our country reeducates through labor the criminal law system construction. On the basis of comparative analysis of three modes of legislation of reeducation through labor, this paper expounds that only alone legislation is the scientific orientation of the mode of legalization of criminal education through labor. From the name of the law and the content of the law, the author designs the criminal legislation of reeducation through labor, thus carries on the ideal conception to the criminal law of reeducation through labor.
