【摘要】： 本文從對(duì)社會(huì)治安防控體系的定義、基本特征、產(chǎn)生的時(shí)代背景和總體目標(biāo)的研究出發(fā),指出社會(huì)治安防控所體現(xiàn)的法價(jià)值在于:實(shí)現(xiàn)自由與秩序的動(dòng)態(tài)平衡、保證公正正義和公平正義統(tǒng)一協(xié)調(diào)、以人為本實(shí)現(xiàn)人的全面發(fā)展。通過對(duì)法理學(xué)視閾下人文、人文關(guān)懷、社會(huì)治安防控中的人文關(guān)懷的內(nèi)涵和特征進(jìn)行分析,提出構(gòu)建和諧社會(huì)的法治秩序需要人文關(guān)懷。在社會(huì)治安防控中,人文關(guān)懷缺失主要表現(xiàn)在:濫用強(qiáng)制性手段、以權(quán)力“尋租”、重打擊輕保護(hù)、執(zhí)法不計(jì)成本、執(zhí)法缺乏公正與公平、執(zhí)法中缺乏服務(wù)意識(shí)等方面。具體分析其中的原因,包括文化傳統(tǒng)因素、法律運(yùn)行因素、社會(huì)體制因素、經(jīng)濟(jì)發(fā)展因素和執(zhí)法主體因素。為此,必須結(jié)合我國的國情,從立法、教育、管理、監(jiān)督、保障等多個(gè)層面進(jìn)行綜合治理。即:確立體現(xiàn)人文關(guān)懷的法治精神和理念,完善彰顯人文精神的公安法律體系,構(gòu)建保障人文關(guān)懷的執(zhí)法機(jī)制,樹立以人為本的執(zhí)法觀念,培養(yǎng)善于與公眾通融的執(zhí)法主體。
[Abstract]:Based on the study of the definition, basic characteristics, background and overall goal of social security prevention and control system, this paper points out that the legal value of social security prevention and control lies in: realizing the dynamic balance between freedom and order. To ensure that justice and justice are unified and coordinated, and that people-oriented realization of the overall development of human beings. Based on the analysis of the connotation and characteristics of humanism, humanistic care and social security prevention and control under the view of jurisprudence, it is pointed out that humanistic care is needed to construct the legal order of a harmonious society. In the prevention and control of social public order, the lack of humanistic care is mainly manifested in the following aspects: abuse of compulsory means, "rent-seeking" with power, emphasis on striking down and light protection, law enforcement regardless of cost, lack of justice and fairness in law enforcement, lack of service consciousness in law enforcement, etc. The reasons include cultural tradition, law operation, social system, economic development and law enforcement. Therefore, we must combine the national conditions of our country, from the legislation, education, management, supervision, security and other aspects of comprehensive management. That is, to establish the spirit and idea of the rule of law that embodies humanistic care, to perfect the public security law system, to construct the law enforcement mechanism to guarantee humanistic care, to establish the people-oriented concept of law enforcement, and to cultivate the law enforcement subject who is good at accommodating with the public.
