【摘要】： 有組織犯罪是一種極其嚴重的犯罪，其活動和危害已遠遠超出了 一個國家的范圍，對社會具有巨大的危害性和整體沖擊性，因而已成 為世界各國立法、司法機關和刑法理論研究者共同關注的熱點問題。 本文系統(tǒng)研究了中外學者對有組織犯罪概念的不同觀點，并提出了自 己對于有組織犯罪基本認識與觀點，深入淺出地分析了有組織犯罪的 六種不同類型。同時還對有組織犯罪的四大基本特征進行了闡述，并 從政治、經濟、社會、心理等方面分析了有組織犯罪產生的原因。著 重闡述了有組織犯罪的懲治和預防，為有效打擊有組織犯罪，須建立 專門的懲治機構，完善刑事立法，完善懲治根據(jù)。治標更要治本，對 有組織犯罪，，不僅要有效打擊，更要重在預防，本文從宏觀、微觀兩 方面試著提出有組織犯罪的預防措施。另外，更要加強國際合作，通 過世界各國的通力合作，共同打擊和預防有組織犯罪。
[Abstract]:Organized crime is an extremely serious crime, and its activities and harm have gone far beyond the scope of one country and have great harmfulness and overall impact on society, As a result, it has become a hot issue of legislation, judicial organs and criminal law theory researchers all over the world. This paper systematically studies the different views of Chinese and foreign scholars on the concept of organized crime, and puts forward the basic understanding and viewpoint of organized crime. Six different types of organized crime are analyzed in detail. At the same time, it expounds the four basic characteristics of organized crime, and analyzes the causes of organized crime from the aspects of politics, economy, society, psychology and so on. In order to effectively combat organized crime, it is necessary to set up special punishment institutions, perfect criminal legislation and perfect the basis of punishment. To deal with the symptoms, we should not only effectively crack down on organized crime, but also focus on prevention. This paper tries to put forward the preventive measures of organized crime from macro and micro aspects. In addition, it is necessary to strengthen international cooperation and to work together to combat and prevent organized crime through the concerted efforts of all countries in the world.
