【摘要】：關于基層經(jīng)濟型職務犯罪,本文主要運用歷史的研究方法,分類研究的方法、實證研究的方法和比較法方法,對基層經(jīng)濟型職務犯罪的基本問題進行研究,以期對完善立法、防范和控制基層經(jīng)濟型職務犯罪有所助益。第一部分主要就基層經(jīng)濟型職務犯罪的概念、特征和加以研究。關于基層經(jīng)濟型職務犯罪的概念,本文主要從職務犯罪的概念著手,運用比較的方法分析其概念。第二部分主要研究基層經(jīng)濟型職務犯罪的現(xiàn)狀,主要從基層城區(qū)經(jīng)濟型職務犯罪的總體情況和農(nóng)村經(jīng)濟型職務犯罪的現(xiàn)狀兩方面進行分析。第三部分研究基層經(jīng)濟型職務犯罪的原因及其危害,包括:職務犯罪原因的總體背景分析、基層經(jīng)濟型職務犯罪原因的探析、基層經(jīng)濟型職務犯罪的危害。第四部分研究在防范與控制基層經(jīng)濟型職務犯罪方面的現(xiàn)狀與不足。一是立法的現(xiàn)狀與不足;二是基層檢察機關在防范與控制基層經(jīng)濟型職務犯罪方面的現(xiàn)狀缺陷。有關立法的缺陷,主要從以下幾方面分析:顯現(xiàn)刑法典關于職務犯罪方面的規(guī)定過于分散,一些經(jīng)濟型職務犯罪的法定刑失之過輕或過重,某些經(jīng)濟型職務犯罪中的某些單個罪名的罪狀規(guī)定不合理。第五部分對如何防范與控制基層經(jīng)濟型職務犯罪的一些構(gòu)思。一是介紹國際社會預防和控制職務犯罪的形勢;二是防控要結(jié)合我國的具體情況,具體分析;三是如何防范與控制基層經(jīng)濟型職務犯罪的一些構(gòu)想,主要從立法、司法機制、制度的完善以及人員素質(zhì)的提高等方面來論述。
[Abstract]:On the basic economic duty crime, this article mainly uses the historical research method, the classification research method, the demonstration research method and the comparative method, carries on the research to the basic economic duty crime basic question, in order to consummate the legislation, It is helpful to prevent and control economic duty crime at the grass-roots level. The first part is mainly about the concept, characteristics and research of economic duty crime. On the concept of basic-level economic job-related crime, this paper mainly starts with the concept of job-related crime, and uses comparative method to analyze its concept. The second part mainly studies the present situation of the economic duty crime at the grass-roots level, mainly from two aspects: the general situation of the economic duty crime in the grass-roots urban area and the present situation of the economic duty crime in the countryside. The third part studies the cause and harm of the economic duty crime at the grass-roots level, including: the general background analysis of the cause of the duty crime, the analysis of the cause of the economic duty crime at the basic level, and the harm of the crime of the duty crime of the economy type at the grass-roots level. The fourth part studies the present situation and the insufficiency in preventing and controlling the economic duty crime at the grass-roots level. The first is the current situation and deficiency of the legislation, the second is the defect of the basic procuratorial organ in preventing and controlling the economic duty crime at the grass-roots level. The defects of the relevant legislation are mainly analyzed from the following aspects: it shows that the provisions of the Criminal Code on job-related crimes are too scattered, and that the statutory penalties of some economic job-related crimes are too light or too heavy. The provisions of certain individual charges in some economic duty crimes are unreasonable. The fifth part is about how to prevent and control the basic economic duty crime. The first is to introduce the situation of preventing and controlling job-related crimes in the international community, the other is to analyze the situation of prevention and control according to the specific situation of our country. The third is how to prevent and control the basic economic duty crime, mainly from the legislative, judicial mechanism, the perfection of the system and the improvement of personnel quality.
