【摘要】：近年來(lái),恐怖分子借助現(xiàn)代工具不斷制造慘劇,反恐斗爭(zhēng)形勢(shì)緊迫,然則學(xué)者們?cè)诳植婪缸锏母拍睢⒎揽赝緩降纫恍┲匾獑?wèn)題上仍未達(dá)成共識(shí)。本文通過(guò)文獻(xiàn)研究外,更多地采用跨學(xué)科研究的方法,對(duì)反恐斗爭(zhēng)綜合治理進(jìn)行了初步研究。 恐怖犯罪的滋生既有國(guó)外霸權(quán)主義的助力,又有國(guó)內(nèi)政治、經(jīng)濟(jì)、文化環(huán)境和特殊地理、歷史因素的影響,還有個(gè)人性格缺陷和社會(huì)管理的缺失,故反恐斗爭(zhēng)不是一個(gè)學(xué)科、部門(mén)能完成,必須綜合治理。反恐斗爭(zhēng)綜合治理原理包括：建立“多方參與、多措并舉”的綜合治理體制機(jī)制,貫徹“打防結(jié)合、以防為主”的綜合治理指導(dǎo)思想,落實(shí)“標(biāo)本兼治、重在治本”的綜合治理根本要求,堅(jiān)持“有法可依、依法防控”綜合治理基本原則。反恐斗爭(zhēng)綜合治理具體模式因各地區(qū)不同的反恐形勢(shì)而異,總體上講,應(yīng)當(dāng)堅(jiān)持以法治恐的原則,綜合運(yùn)用政治、行政等手段,加強(qiáng)社會(huì)防范；持之以恒地在公民的人格塑造、信仰培育、國(guó)民認(rèn)同建構(gòu)和法律守護(hù)等方面加大投入,引導(dǎo)公民通過(guò)正常渠道反映訴求、解決問(wèn)題,做好恐怖犯罪的特殊預(yù)防；營(yíng)造公正公平的政治經(jīng)濟(jì)環(huán)境,加強(qiáng)社會(huì)事務(wù)管理和深入開(kāi)展正確人生觀宣傳教育,做好恐怖犯罪的一般預(yù)防。綜合治理參與單位和人員的權(quán)力和義務(wù),各個(gè)關(guān)鍵環(huán)節(jié)都需要用法律法規(guī)來(lái)規(guī)范才能有秩序、管長(zhǎng)久。
[Abstract]:In recent years, terrorists use modern tools to create tragedies, and the situation of the fight against terrorism is urgent. However, scholars have not reached a consensus on some important issues such as the concept of terrorist crime, the ways of prevention and control, and so on. In addition to the literature study, this paper makes a preliminary study on the comprehensive management of the fight against terrorism by adopting more interdisciplinary research methods. The breeding of terrorist crimes has not only the help of foreign hegemonism, but also the influence of domestic politics, economy, cultural environment and special geography, historical factors, personal personality defects and the lack of social management.Therefore, the struggle against terrorism is not a discipline. Departments can complete, must be comprehensive management. The principles of comprehensive management in the struggle against terrorism include: establishing a comprehensive management system mechanism of "multi-party participation, multi-measures and simultaneous development", carrying out the guiding ideology of "combination of striking, attacking and preventing, and giving priority to prevention", and carrying out the guiding ideology of "treating both the symptoms and the root of the disease." Emphasis is placed on the fundamental requirements of comprehensive management, and the basic principle of comprehensive management is "there are laws to be followed, prevention and control according to law". The concrete mode of comprehensive management of anti-terrorism struggle varies according to different anti-terrorism situations in different regions. Generally speaking, we should adhere to the principle of rule of law and terrorism, and comprehensively use political and administrative means to strengthen social prevention. Persevering in shaping the personality of the citizen, cultivating the belief, constructing the national identity and protecting the law, etc., to guide the citizens to reflect their demands through the normal channels, solve the problems, and do a good job in the special prevention of the terrorist crime; We should build a just and fair political and economic environment, strengthen the management of social affairs and carry out the propaganda and education of correct outlook on life, and do a good job in the general prevention of terrorist crimes. To comprehensively manage the rights and obligations of participating units and personnel, all key links need to be regulated by laws and regulations in order to be orderly and managed for a long time.
