【摘要】：隨著我國科學(xué)技術(shù)的迅猛發(fā)展,傳播淫穢物品的行為出現(xiàn)了方式多樣化、模式復(fù)雜化的特點,手機(jī)涉黃網(wǎng)站的泛濫不僅污染了手機(jī)網(wǎng)絡(luò)環(huán)境,更是破壞了我國互聯(lián)網(wǎng)運行的正常秩序,嚴(yán)重危害了人們的身心健康,有人更是提出“任由黃毒蔓延,其結(jié)果將是一場災(zāi)難”。 本文通過引入互聯(lián)網(wǎng)和手機(jī)色情信息犯罪的一組典型案例,從中總結(jié)出此類新型犯罪的特點和存在的法律問題,包括操作行為的私密性、參與主體呈企業(yè)化、規(guī)�；�、傳播方式具有域外性、信息傳播的暴利性等,然后在案例基礎(chǔ)上分析此類犯罪的運行模式,進(jìn)一步明確案件的參與主體,包括直接參與者、間接參與者和潛在參與者,并對參與主體進(jìn)行責(zé)任認(rèn)定,為明確參與主體的責(zé)任尋找相關(guān)的法律依據(jù)。 最后,結(jié)合我國目前的現(xiàn)狀,借鑒國外的監(jiān)管和立法,分析手機(jī)網(wǎng)絡(luò)犯罪防范的長效機(jī)制,從技術(shù)方面進(jìn)行法律規(guī)制,加強(qiáng)行業(yè)自律,輿論監(jiān)督等,加強(qiáng)對色情信息的過濾監(jiān)管,做到依法辦網(wǎng)、依法管網(wǎng)、依法治網(wǎng),從根本上減少和杜絕互聯(lián)網(wǎng)和手機(jī)色情信息犯罪,凈化網(wǎng)絡(luò)環(huán)境,推進(jìn)互聯(lián)網(wǎng)、手機(jī)信息傳播的的文明、健康發(fā)展,從而構(gòu)建持久、綠色、和諧的手機(jī)網(wǎng)絡(luò)。
[Abstract]:With the rapid development of science and technology in our country, the behavior of spreading obscene materials has appeared the characteristic of diversification of ways and complicated mode. The proliferation of mobile websites not only pollutes the mobile phone network environment, It also destroys the normal order of the operation of the Internet in our country, seriously endangers the physical and mental health of people, and some people even put forward that "letting yellow poison spread, its result will be a disaster". By introducing a group of typical cases of Internet and mobile phone pornographic information crime, this paper summarizes the characteristics and legal problems of this new type of crime, including the privacy of the operation behavior, the corporatization and scale of the participants. The mode of communication is extraterritorial, the information dissemination is profiteering and so on. Then on the basis of case analysis, the operation mode of this kind of crime is analyzed, and the participants of the case, including direct participants, indirect participants and potential participants, are further clarified. And the main responsibility of the participants to identify the responsibility for clear participation of the main body to find the relevant legal basis. Finally, combining the present situation of our country, drawing lessons from the foreign supervision and legislation, analyzing the long-term mechanism of preventing the mobile phone network crime, carrying on the legal regulation from the technical aspect, strengthening the self-discipline of the industry, supervision by the public opinion, etc. To strengthen the filtering and supervision of pornographic information, to run networks according to law, to manage networks according to law, to administer networks according to law, to fundamentally reduce and eliminate crimes of pornographic information on the Internet and mobile phones, to purify the network environment, and to promote the civilization of the dissemination of information on the Internet and mobile phones. Healthy development, thus building a lasting, green, harmonious mobile phone network.
