【摘要】： 隨著網(wǎng)絡(luò)技術(shù)的發(fā)展，我國網(wǎng)絡(luò)違法犯罪問題日益突出，未來信息化社會(huì)違法犯罪的形式將主要是計(jì)算機(jī)網(wǎng)絡(luò)違法犯罪，其嚴(yán)重危害性己引起社會(huì)的高度重視。因此預(yù)防和打擊與日俱增的網(wǎng)絡(luò)違法犯罪，已成為各國政府面臨的嚴(yán)峻挑戰(zhàn)和現(xiàn)代犯罪對(duì)策研究的新課題。 本文依托筆者的實(shí)際工作經(jīng)驗(yàn)，基于目前我國網(wǎng)絡(luò)違法犯罪所存在的問題，并在以往犯罪學(xué)相關(guān)理論研究與目前國內(nèi)外主流研究思路基礎(chǔ)之上，提出了本文的研究構(gòu)思和研究方法，主要是對(duì)全國偵辦網(wǎng)絡(luò)違法犯罪案件中20805多個(gè)案件樣本的不同特征按年齡段、案件類別、涉案領(lǐng)域等進(jìn)行了分類統(tǒng)計(jì)，并利用SPSS13.0對(duì)這20805多個(gè)案件樣本進(jìn)行相應(yīng)的統(tǒng)計(jì)分析。在深入了解我國網(wǎng)絡(luò)違法犯罪現(xiàn)狀基礎(chǔ)之上，并基于現(xiàn)代犯罪學(xué)和經(jīng)濟(jì)學(xué)等相關(guān)理論解釋和討論，，同時(shí)結(jié)合相關(guān)訪談和案例研究分析其中的原因。本文主要研究結(jié)論包括以下幾個(gè)方面： 第一，網(wǎng)絡(luò)違法犯罪案件中，嫌疑人涉案特征與嫌疑人的年齡有顯著的相關(guān)性，涉案領(lǐng)域與所涉案件顯著相關(guān)，專線用戶及網(wǎng)吧發(fā)案對(duì)于整個(gè)網(wǎng)絡(luò)犯罪案件的“貢獻(xiàn)”是最大的，管理好專線用戶及網(wǎng)吧，對(duì)于預(yù)防及打擊網(wǎng)絡(luò)違法犯罪案件來說極為重要。針對(duì)高發(fā)案件、高發(fā)人群、高發(fā)領(lǐng)域、高發(fā)的原因及打擊預(yù)防對(duì)策展開研究，是本文的重點(diǎn)。 第二，涉案總價(jià)值與案件、財(cái)物總損失與涉案總價(jià)值之間是等級(jí)相關(guān)的，賭博犯罪、其他(侵犯財(cái)產(chǎn))犯罪、詐騙犯罪已經(jīng)成為造成財(cái)物損失最嚴(yán)重，涉案價(jià)值最大的犯罪類型。 第三，經(jīng)濟(jì)的發(fā)達(dá)程度與網(wǎng)絡(luò)違法犯罪案件的多少相關(guān)，網(wǎng)監(jiān)隊(duì)伍的機(jī)構(gòu)建設(shè)，人才建設(shè)應(yīng)當(dāng)與該地區(qū)經(jīng)濟(jì)發(fā)展程度、網(wǎng)絡(luò)違法犯罪案件的現(xiàn)實(shí)發(fā)展相適應(yīng)。公安機(jī)關(guān)加強(qiáng)機(jī)構(gòu)建設(shè)將有助于有效打擊網(wǎng)絡(luò)違法犯罪。 第四，網(wǎng)絡(luò)環(huán)境對(duì)網(wǎng)絡(luò)違法犯罪影響很大。相關(guān)法律、法規(guī)的制定相對(duì)于案件的發(fā)展嚴(yán)重滯后了，應(yīng)充分借鑒國內(nèi)外成功經(jīng)驗(yàn)，結(jié)合我國的網(wǎng)絡(luò)環(huán)境、社會(huì)環(huán)境等，加速網(wǎng)絡(luò)違法犯罪方面的立法。網(wǎng)絡(luò)犯罪成本低廉卻收益豐厚，結(jié)合“經(jīng)濟(jì)人”的觀點(diǎn)分析預(yù)防、打擊網(wǎng)絡(luò)違法犯罪確實(shí)長期而艱巨，任重而道遠(yuǎn)。 據(jù)此構(gòu)建防控體系的對(duì)策：在加強(qiáng)網(wǎng)絡(luò)法制及文化教育，管理好網(wǎng)吧等上網(wǎng)場所，加快網(wǎng)絡(luò)方面的立法，加強(qiáng)網(wǎng)監(jiān)隊(duì)伍建設(shè)，重視業(yè)務(wù)培訓(xùn)，加快網(wǎng)絡(luò)安全技術(shù)和安全設(shè)備的研究開發(fā)，并在偵察方面有所突破和創(chuàng)新。
[Abstract]:With the development of network technology, the problem of network illegal crime is becoming more and more prominent in our country. In the future, the form of illegal crime in information society will be mainly computer network crime, and its serious harmfulness has been paid great attention to by the society. Therefore, preventing and cracking down on the increasing number of cyber crimes has become a serious challenge for governments and a new topic for the study of modern crime countermeasures. This article relies on the author's practical work experience, based on the existing problems of our country's network illegal crime, and based on the previous criminology related theoretical research and the current domestic and foreign mainstream research ideas foundation, The paper puts forward the research conception and research method of this paper. It mainly classifies the different characteristics of more than 20805 cases in the investigation and handling of cybercrime cases according to the age group, the category of cases, the fields involved in the case, and so on. And use SPSS13.0 to carry on the corresponding statistical analysis to the more than 20805 case sample. On the basis of deep understanding of the current situation of network crime in China, and based on modern criminology and economics and other related theory explanation and discussion, combined with relevant interviews and case studies to analyze the reasons. The main conclusions of this paper include the following aspects: first, the characteristics of suspects involved in criminal cases are significantly correlated with the age of the suspects, and the areas involved are significantly related to the cases involved. Private line users and Internet cafes make the greatest contribution to the whole network crime cases. It is very important to manage the users and Internet cafes to prevent and crack down on network crimes. It is the focus of this paper to study the causes and countermeasures of high incidence cases, high incidence population, high incidence areas. Second, the total value of the case and the case, the total loss of property and the total value of the case are hierarchically related. Gambling crimes, other (property infringement) crimes, and fraud crimes have become the most serious causes of property losses. The most valuable type of crime involved. Thirdly, the degree of economic development is related to the number of network illegal crime cases. The construction of network supervision team and the construction of talents should be adapted to the economic development degree of the region and the actual development of the network illegal crime cases. The public security organ strengthens the organization construction will help to crack down the network illegal crime effectively. Fourth, the network environment has a great impact on network crime. The formulation of relevant laws and regulations has lagged behind the development of cases. We should learn from domestic and foreign successful experience, combine the network environment and social environment of our country, accelerate the legislation of network illegal crime. The cost of network crime is low but the profit is rich. According to the viewpoint of "economic man", it is a long time and arduous to crack down on network crime, and there is a long and long way to go. Accordingly, the countermeasures of constructing the prevention and control system are as follows: strengthening the network legal system and cultural education, managing the Internet cafes, speeding up the legislation on the network, strengthening the construction of the network supervision team, and attaching importance to the professional training. Speed up the research and development of network security technology and security equipment, and some breakthroughs and innovations in reconnaissance.
