【摘要】： 本文基于犯罪是社會越軌行為,是社會化過程的缺陷或障礙導(dǎo)致的,對罪犯矯正就是使其再社會化的社會學(xué)理論,對社區(qū)矯正對象這一特殊弱勢群體再社會化進行研究。 作者試圖打破監(jiān)禁學(xué)和刑法的束縛,將再社會化的研究拓展到社區(qū)矯正對象,在社會大背景下對其再社會化進行法律社會學(xué)視角的研究。研究采用個案訪談法和參與觀察法,對社區(qū)矯正對象再社會化進行定性研究。確定將影響社區(qū)矯正對象再社會化的因素及其之間的關(guān)系作為主要研究內(nèi)容,最后針對影響社區(qū)矯正對象再社會化的外因提出對策。 本文將影響社區(qū)矯正對象再社會化的因變量進行社會學(xué)的梳理并細(xì)化了影響因素,并運用唯物辯證法解釋社區(qū)矯正對象再社會化過程。內(nèi)因和外因在相互作用下形成矛盾體;唯物辯證法認(rèn)為外因是變化的條件,內(nèi)因是變化的根據(jù),外因通過內(nèi)因而起作用。行為者在矛盾體的刺激下作出具有決定意義的自主選擇。從再社會化的過程發(fā)現(xiàn),再社會化的效果具有一定的隨機性和偶然性,也預(yù)示著社區(qū)矯正對象再社會化的復(fù)雜性和反復(fù)性。對策只能起到促進作用,矯正對象的自主選擇,很大程度上決定了再社會化的效果。 社區(qū)矯正對象是社會的特殊弱勢群體,處理不好也可能使犯罪人“二進宮,三進宮”。社會能夠重視社區(qū)矯正對象這一群體,了解他們的處境,為他們的再社會化創(chuàng)造好的社會環(huán)境,這既是對社區(qū)矯正對象負(fù)責(zé),也是對社會負(fù)責(zé),否則,這些社區(qū)矯正對象隨時有可能再次危害社會。
[Abstract]:Based on the fact that crime is a social deviant behavior and is caused by defects or obstacles in the socialization process, the sociological theory of resocialization of criminals is the sociological theory of resocialization of criminals, and the resocialization of the special vulnerable group of the object of community correction is studied. The author tries to break the shackles of imprisonment and criminal law, extend the research of re-socialization to the object of community correction, and carry out the research on its re-socialization from the perspective of legal sociology under the background of society. Case-interview and participatory observation were used to analyze the re-socialization of community correction objects qualitatively. The main contents of this study are the factors affecting the re-socialization of community correction objects and the relationship between them. Finally, the countermeasures are put forward for the external factors that affect the re-socialization of community correction objects. In this paper, the dependent variables affecting the re-socialization of community correction objects are combed sociologically and the influencing factors are refined, and the process of re-socialization of community correction objects is explained by materialist dialectics. Internal cause and external factor form contradictory body under the interaction; materialist dialectics holds that external cause is the condition of change, internal cause is the basis of change, and external cause works through internal cause. The actor makes a decisive and independent choice under the stimulus of contradiction. From the process of re-socialization, it is found that the effect of re-socialization has some randomness and contingency, and it also indicates the complexity and repetition of the re-socialization of community correction objects. Countermeasures can only play a promoting role, and the self-choice of corrective objects determines the effect of re-socialization to a great extent. The object of community correction is the special vulnerable group of the society, which can also make the criminals "Erjin Palace" and "Sanjin Palace". The society can pay attention to the community correction object group, understand their situation, and create a good social environment for their re-socialization. This is not only responsible to the community correction object, but also to the society, otherwise, These community correction objects may harm the society again at any time.
