【摘要】：在現(xiàn)實(shí)社會(huì)中,由于計(jì)算機(jī)網(wǎng)絡(luò)技術(shù)的不斷普及,許多傳統(tǒng)的問(wèn)題正往網(wǎng)絡(luò)化方向發(fā)展,目前在已經(jīng)出現(xiàn)了網(wǎng)絡(luò)敲詐、網(wǎng)絡(luò)賭球、網(wǎng)絡(luò)販賣(mài)毒品等形式,而且現(xiàn)實(shí)中的一些犯罪案件也需要警察從計(jì)算機(jī)網(wǎng)絡(luò)中來(lái)尋找犯罪的證據(jù)和破案的線索。這使得司法部門(mén)必須要面對(duì)計(jì)算機(jī)證據(jù)獲取和計(jì)算機(jī)證據(jù)應(yīng)用的難題。 本文在對(duì)計(jì)算機(jī)取證技術(shù)現(xiàn)狀分析的基礎(chǔ)上,分析目前計(jì)算機(jī)取證在研究和實(shí)現(xiàn)上所存在的缺陷,并首先對(duì)計(jì)算機(jī)證據(jù)的定義、特征以及法律表現(xiàn)形式進(jìn)行簡(jiǎn)單的概述,指出無(wú)論從特性上還是從提高計(jì)算機(jī)證據(jù)法律地位上,都應(yīng)該將計(jì)算機(jī)證據(jù)作為一種獨(dú)立的證據(jù)形式進(jìn)行研究。 進(jìn)一步,本文在已有的計(jì)算機(jī)取證模型上,根據(jù)實(shí)際計(jì)算機(jī)取證工作中所遇到的問(wèn)題,提出了一種更為完善的計(jì)算機(jī)取證工作模型,以指導(dǎo)計(jì)算機(jī)取證工作的順利進(jìn)行,并同時(shí)對(duì)計(jì)算機(jī)取證的準(zhǔn)備工作、計(jì)算機(jī)證據(jù)的取證以及計(jì)算機(jī)證據(jù)的分析都分別進(jìn)行了詳細(xì)的研究。最后在對(duì)計(jì)算機(jī)取證模型以及計(jì)算機(jī)取證流程進(jìn)行分析的基礎(chǔ)上,完成了計(jì)算機(jī)取證平臺(tái)的設(shè)計(jì)與實(shí)現(xiàn)。以期為計(jì)算機(jī)取證技術(shù)的研究提供一點(diǎn)幫助。
[Abstract]:In the real society, because of the continuous popularization of computer network technology, many traditional problems are developing towards the network direction. At present, there have been network extortion, network gambling, network drug trafficking and so on. Moreover, some crime cases also need the police to look for evidence and clues to solve the crime from the computer network. This makes the judiciary have to face the problem of computer evidence acquisition and computer evidence application. Based on the analysis of the current situation of computer forensics technology, this paper analyzes the defects in the research and implementation of computer forensics at present, and firstly summarizes the definition, characteristics and legal forms of computer evidence. It is pointed out that computer evidence should be studied as an independent form of evidence either in terms of characteristics or in terms of improving the legal status of computer evidence. Furthermore, based on the existing computer forensics model and the problems encountered in the actual computer forensics work, a more perfect computer forensics work model is put forward in order to guide the computer forensics work smoothly. At the same time, the preparation of computer evidence, the evidence of computer evidence and the analysis of computer evidence are studied in detail. Finally, based on the analysis of the computer forensics model and the computer forensics process, the design and implementation of the computer forensics platform are completed. In order to provide some help for the research of computer forensics technology.
