【摘要】：我國公安機關(guān)的治安行政管理是在計劃經(jīng)濟條件下形成的一種特殊的管理體制，在社會主義市場經(jīng)濟條件下，已不適應(yīng)社會發(fā)展的需要，呈現(xiàn)出很多現(xiàn)實弊端，亟需加以改革。警察就其本質(zhì)來說，是和犯罪現(xiàn)象聯(lián)系在一起的，并不具有行政管理的職能。我國現(xiàn)行治安行政管理包含了刑事司法和行政管理兩方面的內(nèi)容，其實質(zhì)是行政司法化和司法行政化。為克服現(xiàn)行治安行政管理在實踐和理論上的弊端，，應(yīng)取消“治安行政管理”這一概念。要根據(jù)權(quán)力分立的原則，將現(xiàn)行治安行政管理中的刑事司法與行政管理分離。對其中的刑事司法事項不應(yīng)再由行政機關(guān)采用行政的方法進(jìn)行管理，應(yīng)交給專門的警察部門管轄；對其中的行政管理事項不應(yīng)再由警察部門管理，應(yīng)實現(xiàn)非警察化，由其他行政部門管理或?qū)嵭猩鐣芾怼?br/>[Abstract]:The public security administration of our country's public security organ is a kind of special management system formed under the planned economy condition. Under the condition of socialist market economy, it has not adapted to the need of the social development, showing a lot of practical malpractices, which need to be reformed urgently. The police, by its nature, are associated with criminal phenomena and do not have the function of administration. The present public security administration in our country includes two aspects of criminal justice and administrative management, and its essence is the administration of justice and administration of justice. In order to overcome the practical and theoretical drawbacks of the current public security administration, the concept of "public security administration" should be abolished. According to the principle of separation of powers, the criminal judicature and administration in the current public security administration should be separated. Criminal justice matters among them should no longer be managed by administrative agencies in an administrative manner and should be placed under the jurisdiction of specialized police departments; The administrative matters should not be managed by the police department, but should be de-policed and managed by other administrative departments or socialized.
