【摘要】：盡管國(guó)內(nèi)犯罪學(xué)理論研究視野開闊并形成了完整的理論體系,其背靠社會(huì)學(xué)的發(fā)展也使得它在法學(xué)領(lǐng)域擁有相當(dāng)大的影響力,但是,社會(huì)對(duì)犯罪理論的過高期待與信息資源的相對(duì)短缺,極大阻礙著犯罪學(xué)的縱深研究;三段式理論的固化和泛化研究替代嚴(yán)謹(jǐn)論證的做法,也導(dǎo)致問題與立論分離;經(jīng)驗(yàn)觀察替代科學(xué)實(shí)證,降低了犯罪學(xué)的學(xué)科價(jià)值。為此,犯罪學(xué)的解困在于恪守事實(shí)科學(xué)的本分,保持獨(dú)立批判的眼光。
[Abstract]:Although the theory of criminology in China has a wide field of vision and formed a complete theoretical system, with the development of sociology, it also has a considerable influence in the field of law, but, The high expectation of crime theory and the relative shortage of information resources greatly hinder the in-depth study of criminology. The solidification and generalization of the three-stage theory also lead to the separation of the problem from the argument, and empirical observation replaces the scientific evidence, which reduces the subject value of criminology. Therefore, the solution of criminology lies in adhering to the duty of factual science and maintaining an independent critical vision.
