【摘要】： 當(dāng)前,未成年人犯罪與吸毒販毒、環(huán)境污染并稱為三大社會(huì)公害之一,成為困擾各個(gè)國(guó)家的世界性難題,是各國(guó)政府致力于研究預(yù)防和減少犯罪的首要環(huán)節(jié)。隨著關(guān)注的逐漸深入,無(wú)論是理論界還是實(shí)務(wù)部門都越來(lái)越清醒地意識(shí)到單純地依靠懲治和打擊,已無(wú)法改善未成年人犯罪這一嚴(yán)重社會(huì)問(wèn)題。 未成年人犯罪相對(duì)于成年人犯罪而言,它是一種特殊年齡的行為主體所實(shí)施的犯罪。由于未成年人在辨別能力與控制能力上,較成年人而言并不完備,因而對(duì)未成年人的處遇應(yīng)當(dāng)與成年人區(qū)別開(kāi)來(lái)。監(jiān)禁處遇對(duì)未成年犯罪人而言更意味著消極性,所以對(duì)于未成年犯罪人盡量避免監(jiān)禁而處以非監(jiān)禁待遇已經(jīng)成為各國(guó)少年司法制度的共識(shí)。 本文分為五個(gè)部分。第一部分是未成年人犯罪非監(jiān)禁處遇制度概述,第二部分是未成年人犯罪非監(jiān)禁處遇的基礎(chǔ)理論,第三部分是未成年人犯罪非監(jiān)禁處遇的國(guó)外情況,第四部分是未成年人犯罪非監(jiān)禁處遇的我國(guó)現(xiàn)狀,第五部分是我國(guó)未成年人犯罪非監(jiān)禁處遇制度的構(gòu)建與完善。
[Abstract]:At present, juvenile delinquency, drug abuse and drug trafficking, and environmental pollution are regarded as one of the three major social hazards, which has become a worldwide problem puzzling all countries, and is the primary link for the governments of various countries to study the prevention and reduction of crime. With the gradual deepening of attention, both theoretical and practical departments are more and more aware that relying solely on punishment and punishment can no longer improve the serious social problem of juvenile delinquency. Compared with adult crime, juvenile delinquency is a crime committed by the subject of special age. Because minors are not perfect in discrimination and control, they should be distinguished from adults. Imprisonment is even more negative for juvenile offenders, so it has become the consensus of juvenile justice system to avoid imprisonment and impose non-custodial treatment on underage offenders as far as possible. This paper is divided into five parts. The first part is an overview of the system of non-custodial treatment of juvenile delinquency, the second part is the basic theory of the non-custodial treatment of juvenile delinquency, the third part is the foreign situation of non-custodial juvenile delinquency. The fourth part is the current situation of the non-custodial treatment of juvenile delinquency, and the fifth part is the construction and perfection of the non-custodial treatment system of juvenile delinquency in China.
