【摘要】： “9·11”事件將恐怖主義活動推到了一個前所未有的高峰，國際恐怖主義犯罪成為人類社會最具威脅和嚴重的犯罪。因此各國學者對這方面的課題尤為關注，理論研究也日趨成熟。恐怖主義行為是一種古老的現(xiàn)象，歷史久遠，成因復雜，尤其是當代的恐怖主義涉及到政治、經(jīng)濟、社會、民族和宗教等因素，因此國際恐怖主義犯罪的理論應涉及國際法、國際刑法以及犯罪學、社會學等諸多學科。筆者在研究這一題目時，主要立足于國際刑法的內(nèi)容，帶著社會人文關懷精神，從不同角度深入地進行了思考和探索，，力求在來自四面八方的聲音中找到一個理論基調(diào)。本文由四個部分組成。 第一章中恐怖主義的概念一直是這個課題的重點及難點。筆者并沒有回避這個理論難題，而是通過對世界范圍內(nèi)恐怖主義活動的分析，在總結各國學者豐富的理論成果上，提出了自己的觀點，準確界定了恐怖主義的概念、探討了恐怖主義的根源，并且總結了當代恐怖主義的新特征。 第二章中筆者從理論高度總結了各國法學家對國際恐怖主義犯罪的界定，提出了新的思維路線，得出了自己的分析結論，并在該罪的定義、犯罪構成、犯罪特征以及刑事責任方面提出了大膽新穎的設想，構建了國際恐怖主義犯罪基本理論。 第三章的內(nèi)容圍繞防治國際恐怖主義犯罪展開，從立法到刑事合 作，從建立反恐部隊到成立聯(lián)盟，筆者在有限的資料中總結了目前國 際社會有效的防恐反恐措施，指出了不足，提出了個人建議。 第四章中筆者立足于目前中國的恐怖主義犯罪情況，詳細分析了 在過去五十多年里我們國家對于恐怖主義犯罪的法律規(guī)定，特別是97 年新刑法對于這方面的規(guī)定情況，指出了現(xiàn)有刑法不適和滯后，并提 議人大應參照一系列反恐國際公約做出相應的修訂。同時在中國反恐 體制過時，經(jīng)驗不足的現(xiàn)實下，筆者提出了完善相關制度的建議。
[Abstract]:The 9 / 11 incident pushed terrorism to an unprecedented peak. International terrorism has become the most threatening and serious crime in human society. Therefore, scholars all over the world pay particular attention to this aspect of the subject, theoretical research is also maturing day by day. Acts of terrorism are an ancient phenomenon, with a long history and complex causes. In particular, contemporary terrorism involves political, economic, social, ethnic and religious factors. Therefore, the theory of international terrorist crime should involve international law. International criminal law and criminology, sociology and many other disciplines. When studying this topic, the author mainly bases on the content of international criminal law, and with the spirit of social humanistic concern, deeply ponders and explores from different angles, and tries to find a theoretical tone in the voice from all sides. This paper consists of four parts. In the first chapter, the concept of terrorism has always been the focus and difficulty of this subject. The author does not avoid this theoretical problem, but through the analysis of terrorist activities in the world, in summing up the rich theoretical results of scholars in various countries, put forward their own views, accurately defined the concept of terrorism, This paper discusses the root causes of terrorism and summarizes the new characteristics of contemporary terrorism. In the second chapter, the author summarizes the definition of the crime of international terrorism from the theoretical point of view, puts forward a new thinking line, draws his own conclusion, and in the definition of the crime, the composition of the crime. In the aspect of criminal characteristics and criminal liability, the author puts forward bold and new ideas and constructs the basic theory of international terrorism crime. The third chapter focuses on the prevention and control of international terrorist crimes, from legislation to criminal cooperation, from the establishment of anti-terrorist forces to the formation of alliances, In the limited data, the author summarizes the effective measures to prevent terrorism in the society, points out the shortcomings, and puts forward some personal suggestions. In the fourth chapter, based on the current situation of terrorist crimes in China, the author analyzes in detail the legal provisions on terrorist crimes in our country in the past 50 years or so. Especially, the new criminal law in 1997 points out that the existing criminal law is not suitable and lagged behind, and suggests that the NPC should make corresponding amendments with reference to a series of international conventions against terrorism. At the same time, in the reality of outdated and inexperienced anti-terrorism system in China, the author puts forward some suggestions to perfect the relevant system.
