北京奧運(yùn)會反恐研究及對策

【摘要】： 進(jìn)入二十一世紀(jì),特別是911事件以后,恐怖主義已經(jīng)日益成為危害世界和平安全的重要因素,反恐斗爭也日益成為全球各國警方工作的一項(xiàng)重要內(nèi)容。奧林匹克運(yùn)動是當(dāng)今世界上規(guī)模和影響力最大的社會文化運(yùn)動,現(xiàn)代奧林匹克夏季運(yùn)動會則是世界上規(guī)模最大的國際綜合體育盛會。奧運(yùn)會因其相關(guān)活動多、參加人員多、涉及場所多、不確定因素多以及受全球關(guān)注等特點(diǎn),極易成為恐怖分子襲擊的目標(biāo),引發(fā)恐怖襲擊事件。從1972年慕尼黑奧運(yùn)會的劫持人質(zhì)事件到美國亞特蘭大奧運(yùn)會奧運(yùn)公園爆炸案,世界各國警方逐漸清醒而深刻地意識到,恐怖活動已經(jīng)成為當(dāng)今奧運(yùn)會面臨的最大威脅,打擊恐怖主義、防范恐怖襲擊已經(jīng)成為做好奧運(yùn)安保工作的重中之重。自上世紀(jì)90年代初開始,以疆獨(dú)恐怖組織和恐怖分子為代表的“三股勢力”與國際上的恐怖主義組織相聯(lián)系,在境內(nèi)外制造了一系列爆炸、暗殺的恐怖事件,我國境內(nèi)發(fā)生的恐怖主義事件進(jìn)一步趨向國際化和有組織化,其犯罪手段也日趨多樣和復(fù)雜,嚴(yán)重威脅到我國的社會穩(wěn)定。隨著2008年奧運(yùn)會在北京舉辦日期的日益臨近,當(dāng)前,奧運(yùn)反恐工作也面臨著前所未有的嚴(yán)峻形勢。本文著力于從恐怖主義犯罪的研究入手,通過對可能影響北京奧運(yùn)會的各種恐怖犯罪因素的分析,對近幾屆奧運(yùn)會反恐措施進(jìn)行深入比較,將刑法學(xué)和犯罪學(xué)理論與反恐怖斗爭實(shí)踐相結(jié)合,為應(yīng)對2008年奧運(yùn)會反恐工作提供有益建議。文章共分四部分:第一部分是恐怖主義和恐怖主義犯罪概述,主要對恐怖主義和恐怖主義犯罪的定義、恐怖主義犯罪的特征等進(jìn)行一般研究,為開展奧運(yùn)反恐工作提供基礎(chǔ)理論支持;第二部分是對可能影響北京奧運(yùn)會安全的恐怖主義犯罪的主體、形式、手段等做的概述,為奧運(yùn)反恐工作提供工作目標(biāo),確保奧運(yùn)反恐措施的針對性;第三部分通過對近幾屆奧運(yùn)會舉辦國反恐工作情況的介紹,比較和評述各國的奧運(yùn)反恐措施,從中得到啟示,為完善我們的奧運(yùn)反恐措施提供借鑒;第四部分結(jié)合北京警方目前正在進(jìn)行的奧運(yùn)反恐工作實(shí)踐,就如何做好2008年奧運(yùn)反恐工作,從工作機(jī)制、預(yù)防機(jī)制、應(yīng)急反應(yīng)能力等方面提出相應(yīng)的工作建議,以利于建立與國際接軌的反恐斗爭機(jī)制,提高北京奧運(yùn)的反恐能力,推動“平安奧運(yùn)”目標(biāo)的實(shí)現(xiàn),確保2008年奧運(yùn)會的順利召開。
[Abstract]:In the 21 century, especially after 9 / 11, terrorism has become an important factor that endangers the world peace and security, and the fight against terrorism has become an important part of the police work all over the world. The Olympic Movement is the largest social and cultural movement in the world and the modern Olympic Summer Games is the largest international comprehensive sports event in the world. Because of its many related activities, many participants, many places involved, many uncertain factors and the characteristics of global concern, the Olympic Games is easy to be the target of terrorist attacks and trigger terrorist attacks. From the hostage-taking incident at the 1972 Munich Olympic Games to the bombing of the Olympic Park in Atlanta, the world's police have gradually and profoundly realized that terrorist activities have become the greatest threat to the Olympic Games today. Combating terrorism and preventing terrorist attacks have become the top priority of Olympic security work. Since the early 1990s, the "three forces", represented by Xinjiang independent terrorist organizations and terrorists, have been linked to international terrorist organizations and have created a series of terrorist incidents of bombings and assassinations inside and outside the country. The terrorist events in China are becoming more international and organized, and their criminal methods are becoming more and more diverse and complex, which seriously threaten the social stability of our country. With the date of holding the 2008 Olympic Games in Beijing is approaching, the anti-terrorism work of the Olympic Games is facing an unprecedented grim situation. This paper focuses on the study of terrorist crimes, through the analysis of various terrorist crime factors that may affect the Beijing Olympic Games, and makes an in-depth comparison of anti-terrorism measures in recent Olympic Games. Combining the theory of criminal law and criminology with the practice of the struggle against terrorism, this paper provides useful suggestions for the counterterrorism work of the 2008 Olympic Games. The article is divided into four parts: the first part is an overview of terrorism and terrorist crimes, mainly on the definition of terrorism and terrorist crimes, the characteristics of terrorist crimes, etc. To provide basic theoretical support for carrying out the anti-terrorist work of the Olympic Games; The second part is the summary of the subject, form and means of the terrorist crime which may affect the security of the Beijing Olympic Games, to provide the working target for the anti-terrorist work of the Olympic Games, and to ensure the pertinence of the anti-terrorist measures of the Olympic Games. The third part, through the introduction of the anti-terrorism work of the host countries of the recent Olympic Games, compares and comments on the anti-terrorism measures of the Olympic Games in various countries, and draws inspiration from them to provide reference for perfecting our anti-terrorism measures in the Olympic Games. In the fourth part, based on the current practice of the Beijing police working on counter-terrorism in the Olympic Games, the author puts forward corresponding suggestions on how to do a good job in the counter-terrorism work of the 2008 Olympic Games, from the aspects of working mechanism, prevention mechanism, emergency response ability, and so on. It is beneficial to establish the anti-terrorist struggle mechanism in line with international standards, to improve the anti-terrorist ability of Beijing Olympic Games, to promote the realization of the goal of "peaceful Olympics", and to ensure the smooth holding of the 2008 Olympic Games.
