【摘要】：邪教組織犯罪是有組織犯罪的一種傳統(tǒng)犯罪形式。隨著世界形勢與社會(huì)形勢的復(fù)雜多變,邪教組織犯罪呈現(xiàn)多樣化,是世界各國特別是刑法學(xué)界、犯罪學(xué)界及心理學(xué)界予以關(guān)注的熱點(diǎn)問題,也是各國政府常常面臨的最為棘手的難題之一。邪教組織犯罪涉及領(lǐng)域與地域范圍廣、受害人群年齡跨度與職業(yè)跨度大、對政局穩(wěn)定與經(jīng)濟(jì)發(fā)展破壞性極強(qiáng)。近期我國發(fā)生的“全能神”邪教組織事件再次引起我們對邪教組織犯罪的廣泛關(guān)注,在“平安中國、法治中國”推進(jìn)建設(shè)的背景下,邪教組織犯罪的毒瘤需要及時(shí)鏟除。 本文擬就一個(gè)特殊視角——心理學(xué)視角對“邪教組織犯罪”這一課題進(jìn)行探討,從犯罪心理學(xué)角度對邪教組織的犯罪原因、犯罪防控提出自己粗淺的見解。該論文共分為四個(gè)部分：第一部分對邪教組織犯罪進(jìn)行了宏觀性概述。首先從邪教的起源為切入點(diǎn),總結(jié)了邪教與邪教組織的概念；其次是邪教組織犯罪的四大發(fā)展趨勢,當(dāng)今邪教組織的黑社會(huì)化趨勢、國際化趨勢尤為明顯；最后總結(jié)了邪教組織三個(gè)方面的形態(tài)特征,對這三方面特征的分析為后面第二、三、四部分進(jìn)行犯罪原因分析、犯罪防控分析做了鋪墊。本文第二、三部分以心理學(xué)為視角,利用犯罪學(xué)、犯罪心理學(xué)、刑法學(xué)的理論分析闡述了國內(nèi)外邪教組織犯罪的原因,對邪教組織原因的分析分別要從兩個(gè)角度出發(fā)。首先是第二部分以“個(gè)體缺陷”對個(gè)體加入邪教組織進(jìn)而實(shí)施邪教組織犯罪為角度,“個(gè)體缺陷”主要來自于人格社會(huì)化缺陷、變態(tài)人格、精神疾病與智能不足等；其次是第三部分以“邪教組織通過對個(gè)體心理的利用”而誘使群眾入教進(jìn)而實(shí)施邪教組織犯罪為角度,邪教組織主要通過對個(gè)體依賴互補(bǔ)心理、精神控制、隱形脅迫的利用來控制其組織成員。本文第四部分以治本性為目的,以建立和諧社會(huì)為整體性發(fā)展目標(biāo),主要以心理學(xué)為視角對邪教組織犯罪的預(yù)防控制提出了建議,主要包括刑事防控、社會(huì)防控以及分類防控,強(qiáng)調(diào)了社區(qū)模式對犯罪防控的重要意義。
[Abstract]:Cult crime is a traditional form of organized crime. With the complexity of the world situation and the social situation, the crime of cult organizations is becoming more and more diverse, which has become a hot issue in the world, especially in criminal law, criminal and psychological circles. It is also one of the thorniest problems governments often face. The crime of cult organization involves a wide range of fields and regions, and the age span and occupation span of the victims are wide, which is extremely destructive to political stability and economic development. The recent incident of the "omnipotent God" cult organization in our country has once again aroused our extensive concern over the crime of cult organizations. Under the background of promoting the construction of "peaceful China and ruling by law China," the malignant tumor of cult organization crime needs to be eradicated in a timely manner. This paper discusses the subject of "cult organization crime" from the perspective of psychology. From the angle of criminal psychology, the author puts forward his own superficial opinion on the crime prevention and control of cult organization. The thesis is divided into four parts: the first part summarizes the crime of cult organization. Firstly, this paper sums up the concept of cults and cults from the origin of cults, and secondly, the four development trends of cults' crimes, especially the tendency of underworld and internationalization of heretical organizations. Finally, the paper summarizes the morphological characteristics of the three aspects of cult organization, and the analysis of these three features paves the way for the second, third and fourth parts to analyze the causes of crime and the analysis of crime prevention and control. In the second and third parts of this paper, from the perspective of psychology, the theoretical analysis of criminal science, criminal psychology and criminal jurisprudence expounds the causes of the crime of cults both at home and abroad, and the analysis of the causes of cults should be carried out from two angles respectively. First of all, the second part is from the angle of "individual defect" to join the cult organization and then implement the crime of cult organization. The "individual defect" mainly comes from the personality socialization defect, abnormal personality, mental illness and intelligence insufficiency. Secondly, in the third part, from the angle of "the cult organization induces the masses to join the religion through the use of individual psychology" and then implements the crime of cult organization, the cult organization mainly controls the spirit by relying on the complementary psychology to the individual. The use of stealth stress to control its members. The fourth part of this paper aims at the nature of governance, takes the establishment of a harmonious society as the overall development goal, mainly puts forward some suggestions on the prevention and control of cult organization crime from the perspective of psychology, including criminal prevention and control, social prevention and control and classified prevention and control. The importance of community model to crime prevention and control is emphasized.
