【摘要】：眾所周知，，當(dāng)前青少年違法犯罪現(xiàn)象日趨嚴(yán)峻，而且已經(jīng)成為全社會(huì)共同關(guān)注的重大課題。毛澤東同志曾經(jīng)把青少年形象地比作早晨八、九點(diǎn)鐘的太陽(yáng)，并說道：“世界是你們的，也是我們的，歸根結(jié)底還是你們的�！边@足以說明青少年對(duì)于一個(gè)國(guó)家和社會(huì)是何等的重要，而青少年又肩負(fù)著艱巨的歷史使命。所以說青少年問題解決得好與不好，將直接對(duì)國(guó)家對(duì)社會(huì)的前途和命運(yùn)產(chǎn)生深刻的影響。 改革開放給我們的國(guó)家?guī)戆l(fā)展機(jī)遇的同時(shí)，國(guó)內(nèi)社會(huì)治安形勢(shì)卻日趨嚴(yán)峻，其中青少年犯罪成了黨和國(guó)家乃至全社會(huì)共同關(guān)注的社會(huì)問題。中共中央先后做出多項(xiàng)預(yù)防青少年犯罪的決策，國(guó)家也在立法層面上把保護(hù)青少年和預(yù)防青少年犯罪納入了法制軌道。社會(huì)治安“綜合治理”方針政策為預(yù)防青少年犯罪指明了方向，《未成年人保護(hù)法》、《預(yù)防未成年人犯罪法》的實(shí)施，為防治青少年犯罪提供了法律依據(jù)。筆者因工作的性質(zhì)和對(duì)青少年犯罪現(xiàn)象的興趣，在參閱了一些青少年犯罪研究的理論和成果的基礎(chǔ)上，對(duì)所在城市被提起公訴的青少年犯罪案件進(jìn)行了必要的對(duì)比、分析，歸納并總結(jié)了當(dāng)前本地區(qū)青少年犯罪現(xiàn)象在新時(shí)期、新形勢(shì)下呈現(xiàn)出的新特點(diǎn)和原因。由于本市地處少數(shù)民族自治區(qū)域內(nèi)，青少年犯罪必然受地區(qū)因素和民族因素的影響，呈現(xiàn)出與其它地區(qū)的與眾不同。因此對(duì)待青少年犯罪問題也應(yīng)當(dāng)納入地區(qū)的和民族的因素。 本論文共分以下幾個(gè)部分： 第一部分青少年犯罪綜述。對(duì)當(dāng)前青少年犯罪學(xué)術(shù)研究中關(guān)于“青少年犯罪的界定”、“青少年犯罪的原因”作了簡(jiǎn)明闡述，并表明了自己的一些看法。 第二部分包頭市青少年犯罪調(diào)查與分析。包頭市近幾年來青少年犯罪發(fā)案率呈迅速上升勢(shì)頭，有著深刻的社會(huì)背景因素。同時(shí)民族因素也可能對(duì)不同民族青少年犯罪產(chǎn)生一定的影響，如蒙古族特有的文化、風(fēng)俗習(xí)慣、生活生產(chǎn)方式、宗教信仰等因素可能對(duì)蒙古族青少年犯罪產(chǎn)生一定的影響。筆者從這條思路出發(fā)，對(duì)本市青少年犯罪的特點(diǎn)和原因作了比較、分析和歸納。 第三部分包頭市青少年犯罪對(duì)策。研究犯罪，目的是要找出預(yù)防和減少犯罪的辦法和途徑。筆者通過對(duì)包頭市青少年犯罪的研究，提出了一些可能適合本市
[Abstract]:As we all know, the phenomenon of juvenile delinquency is becoming more and more serious, and has become a major concern of the whole society. Comrade Mao Zedong once likened youth to the sun at 8 and 09:00 in the morning, and said, "the world is yours and ours, and ultimately yours." This shows how important young people are to a country and a society, and young people shoulder a difficult historical mission. Therefore, it will have a profound influence on the future and destiny of the society. Reform and opening to the outside world have brought the development opportunity to our country, at the same time, the domestic social security situation is becoming more and more serious, among which juvenile delinquency has become the social problem that the party, the country and the whole society pay attention to together. The CPC Central Committee has made many decisions on the prevention of juvenile delinquency, and the state has also brought the protection of juveniles and the prevention of juvenile delinquency into the legal track at the legislative level. The general policy of "comprehensive management" of social public security has pointed out the direction for the prevention of juvenile delinquency. The implementation of the Law on the Protection of minors and the Law on the Prevention of Juvenile Delinquency provides a legal basis for the prevention and control of juvenile delinquency. Due to the nature of work and interest in juvenile delinquency, the author, on the basis of consulting some theories and achievements of juvenile delinquency research, makes a necessary comparison and analysis of juvenile delinquency cases that have been prosecuted in their cities. This paper sums up and summarizes the new characteristics and causes of juvenile delinquency in this area in the new period and new situation. Because the city is located in the autonomous region of ethnic minorities, juvenile delinquency is bound to be affected by regional and ethnic factors, showing the difference with other regions. Therefore, the problem of juvenile delinquency should also be incorporated into regional and ethnic factors. This paper is divided into the following parts: the first part is a summary of juvenile delinquency. The definition of "juvenile delinquency" and "reasons of juvenile delinquency" in the current academic research on juvenile delinquency are briefly expounded, and some opinions are given. The second part is the investigation and analysis of juvenile delinquency in Baotou City. In recent years, the incidence rate of juvenile delinquency in Baotou City is rising rapidly and has profound social background factors. At the same time, ethnic factors may also have a certain impact on juvenile delinquency of different nationalities, such as Mongolian unique culture, customs, ways of life, religious beliefs and other factors may have a certain impact on Mongolian juvenile delinquency. Based on this idea, the author compares the characteristics and causes of juvenile delinquency in this city. The third part is the countermeasures of juvenile delinquency in Baotou City. The purpose of studying crime is to find ways and means to prevent and reduce crime. Based on the study of juvenile delinquency in Baotou City, the author puts forward some suggestions that may be suitable for this city.
