【摘要】：眾所周知,黑社會(huì)犯罪與販毒、恐怖主義并稱世界三個(gè)犯罪災(zāi)難。自二十世紀(jì)初以來,黑社會(huì)組織就開始在世界各地肆虐,極大地影響了當(dāng)?shù)氐纳鐣?huì)秩序和安定,成為全球性的瘟疫。如何遏制黑社會(huì)犯罪的蔓延趨勢(shì),是擺在各國政府面前必須解決的問題。 我國自改革開放后,隨著境外黑社會(huì)勢(shì)力的滲透和國內(nèi)犯罪團(tuán)伙的組織化發(fā)展,有組織犯罪迅速發(fā)展。黑社會(huì)的組織結(jié)構(gòu)日益嚴(yán)密,有向典型黑社會(huì)發(fā)展的可能。在現(xiàn)實(shí)中,學(xué)術(shù)界掌握的黑社會(huì)犯罪案件數(shù)量較小,得出的結(jié)論并不能代表黑社會(huì)組織所有的特征。為了直觀形象地分析黑社會(huì)組織犯罪,本文以國內(nèi)外的文學(xué)作品為切入點(diǎn),深入分析黑社會(huì)組織。用另一種視角對(duì)我國黑社會(huì)組織犯罪研究進(jìn)行探索,以文學(xué)作品作為展開論證的切入點(diǎn),使得黑社會(huì)組織犯罪研究能夠脫離傳統(tǒng)研究方式的桎梏和枷鎖,用文學(xué)來印證現(xiàn)實(shí),用現(xiàn)實(shí)來探討理論,使黑社會(huì)犯罪研究的理論更加便于接受。 第一章是黑社會(huì)組織犯罪現(xiàn)象分析。該章對(duì)黑社會(huì)的起源、性質(zhì)、亞文化特性和本質(zhì)屬性進(jìn)行了詳細(xì)的介紹,以文學(xué)作品為楔子,用文學(xué)作品來映照現(xiàn)實(shí),透過文學(xué)作品中反映的現(xiàn)實(shí),進(jìn)行法律上的探討。 第二章是黑社會(huì)組織犯罪原因分析。主要從社會(huì)、政治、法律和犯罪亞文化四個(gè)角度進(jìn)行介紹。本章的寫作延續(xù)了第一章文學(xué)與現(xiàn)實(shí)互相映照、夾敘夾議的寫作手法,力圖使本章的內(nèi)容便于理解,脫離晦澀的寫作模式。 第三章是黑社會(huì)組織犯罪對(duì)策研究。主要從立法規(guī)制、司法對(duì)策與探討重慶打黑三個(gè)方面來論述。經(jīng)過比較,得出了我國黑社會(huì)組織犯罪的特點(diǎn)。對(duì)于治理我國黑社會(huì)組織犯罪,提出了幾點(diǎn)建議。 通過本文對(duì)黑社會(huì)犯罪的研究,筆者對(duì)黑社會(huì)犯罪問題提出了自己的觀點(diǎn)。主要體現(xiàn)在立法規(guī)制和司法對(duì)策等方面,以期對(duì)我國黑社會(huì)組織犯罪研究起到一定的積極作用。
[Abstract]:As we all know, underworld crime and drug trafficking, terrorism is known as the world's three criminal disasters. Since the beginning of the 20th century, triad organizations have been rampant all over the world, which have greatly affected the local social order and stability, and become a global plague. How to curb the spreading trend of underworld crime is a problem that must be solved in front of governments. Since China's reform and opening up, organized crime has developed rapidly with the infiltration of foreign underworld forces and the organized development of domestic criminal gangs. The organization structure of underworld is more and more strict, and it is possible to develop to typical underworld. In reality, the number of underworld crimes in academic circles is relatively small, and the conclusion can not represent all the characteristics of underworld organizations. In order to analyze the crime of underworld organization intuitively and vividly, this paper takes literature works at home and abroad as the breakthrough point, deeply analyzes the underworld organization. Using another angle of view to explore the study of underworld organized crime in our country, taking literary works as the starting point of demonstration, making the study of underworld organization crime break away from the shackles and shackles of traditional research methods, and prove the reality with literature. Use the reality to explore the theory, make the theory of the underworld crime more easily accepted. The first chapter is the analysis of the criminal phenomenon of the underworld. This chapter introduces in detail the origin, nature, subcultural characteristics and essential attributes of the underworld, taking literary works as a wedge, using literary works to reflect the reality, and through the reality reflected in literary works, carries on a legal discussion. The second chapter is the analysis of the causes of the organized crime of the underworld. Mainly from the social, political, legal and criminal subculture four angles to introduce. The writing of this chapter continues the writing technique of the first chapter, which reflects the literature and reality, and tries to make the content of this chapter easy to understand and get rid of the obscure writing mode. The third chapter is the research on the countermeasures of the organized crime of the underworld. Mainly from the legislative regulation, the judicial countermeasure and the discussion Chongqing to fight the black three aspects to discuss. After comparison, the characteristics of our country's underworld organized crime are obtained. To control our country underworld organization crime, put forward a few suggestions. Through the study of underworld crime in this paper, the author puts forward his own viewpoint on the problem of underworld crime. It is mainly embodied in the aspects of legislative regulation and judicial countermeasures, in order to play a positive role in the study of triad organized crime in our country.
