【摘要】：全文共分為五個部分。第一部分從主要論述職務犯罪的危害、特點、原因和預防立法的效用闡述職務犯罪與預防立法的關系。第二部分闡述了預防職務犯罪立法的戰(zhàn)略選擇。主要從遏制和預防職務犯罪的根本途徑、有力保障、重要內(nèi)容和基本格局四個方面，論述預防職務犯罪立法的必要性和可行性；第三部分闡述預防職務犯罪立法內(nèi)容的框架設定。包括立法的指導思想和依據(jù)、立法條文的篇章結構、預防職務犯罪的主體及其職責的規(guī)定、預防職務犯罪措施的規(guī)定、預防職務犯罪主管機關的規(guī)定、預防職務犯罪管理機制的規(guī)定等；第四部分闡述預防職務犯罪立法工作中應該處理好的幾種關系。重點論述與預防職務犯罪工作關系密切的幾大關系，，包括與職務犯罪偵查工作的關系、與黨委、紀委(監(jiān)察)部門的關系、與人大、政協(xié)的關系、與人民群眾的關系、與行政機關的關系和與輿論宣傳的關系。第五部分為余論，加強預防立法，保障社會和諧。主要論述預防立法與建設和諧社會的關系和作用。
[Abstract]:The full text is divided into five parts. The first part expounds the relationship between duty crime and preventive legislation from the aspects of harm, characteristics, causes and effectiveness of preventive legislation. The second part expounds the strategic choice of the prevention of duty crime legislation. This paper mainly discusses the necessity and feasibility of legislation on the prevention of job-related crimes from four aspects: the basic ways to contain and prevent job-related crimes, the effective protection, the important contents and the basic pattern. The third part describes the framework of the content of the legislation on the prevention of job-related crimes. Including the guiding ideology and basis of the legislation, the text structure of the legislative provisions, the provisions of the main body and its duties for the prevention of job-related crimes, the provisions of the measures for the prevention of job-related crimes, and the provisions of the competent organs for the prevention of job-related crimes, The regulation of the management mechanism for the prevention of job-related crimes; The fourth part elaborates several relations which should be handled well in the legislative work of preventing duty crime. Focusing on several relations closely related to the prevention of job-related crimes, including those with the investigation of job-related crimes, with party committees, discipline inspection and supervision departments, with the people's congresses and CPPCC conferences, and with the masses of the people, Relations with administrative organs and public opinion propaganda. The fifth part is the conclusion, strengthens the prevention legislation, guarantees the social harmony. This paper mainly discusses the relationship and function between the legislation of prevention and the construction of a harmonious society.
